By combining his extensive business management and litigation experience, Ben offers a uniquely businesslike perspective. The result is a more effective approach to solving even the most complex legal problems with an eye on ensuring the fees do not get ahead of the value.

    Ben is as comfortable in a board room as he is in a courtroom. He writes and speaks about development in employment law in a way that clients find useful and practical. He voraciously reads new decisions and journals, and is constantly looking for ways to translate legal developments into real competitive advantages for his existing and potential clients.

Biography

Ben is passionate about helping his clients reach their full potential. Whether it was helping out in his parent’s flower shop in San Mateo, CA or building retail stores in Long Island, NY, Ben learned firsthand that the best product in the world means nothing unless you have the right people to make it and sell it. He learned that the most polished business plan is nothing more than a stack of paper without the right people to make that business come alive. Indeed, in any competitive market, a company’s success depends on its ability to access the best talent. Companies that fall back on outdated assumptions risk being surpassed by those who recognize the potential in their workforces regardless of age, gender, race, or other arbitrary characteristics. Ben believes that with the right policies in place, employment laws can provide a structure for success, rather than an impediment to profits. It is with this focus that Ben advises his clients.

Mindful of his pre-law experiences, Ben took to his legal studies with a unique sense of perspective. With the help of his professors at Vanderbilt University Law School, Ben crafted a course of study designed to explore specific business challenges from a legal perspective. The result of this intensive study was a series of articles discussing novel approaches to business problems by combining proven business principles with highly sophisticated legal tactics. Many of those articles have been published in leading trade publications and they form the basis of Ben’s practice today.

Whether it is to a jury or a group of concerned business owners, Ben loves speaking about the law. He is as comfortable in a courtroom as he is in a boardroom and his passion for good ideas pervades every case he argues, and every article he writes.

When not at work, Ben can be found on the water racing sailboats or cruising around in his vintage 1959 Lyman Sleeper. Yes, he restored it himself (ask him to show you a picture).

Experience

Franchisor Representation: Termination of Franchisee/Dealer
We represented a Maine-based manufacturer/distributor of automated retrieval systems who needed assistance defending its termination of a Minnesota-based dealer of its products. Calling on their extensive experience and knowledge of state franchise laws around the United States, and Maine Franchise Law in particular, our team of litigators was able to gain a favorable arbitration result by establishing that our client had no liability in terminating this dealer.
Pro Bono Representation of Political Asylum Seeker
After learning of the plight of a refugee of the Somalian civil war through their involvement with the Immigrant’s Legal Assistance Program, Verrill Dana attorneys donated their time to assist her in obtaining political asylum in the United States.
Trademark Dispute: Tao Restaurant
Tao Restaurant, a quiet neighborhood restaurant run by a mother and daughter, was on the receiving end of a complaint brought against them by TAO Licensing, owner of a chain of nightclubs with locations in New York and Las Vegas, claiming that the restaurant was trading on the notoriety and success of the nightclubs and that consumers would be confused into believing that the restaurant and nightclubs were related. In this David vs. Goliath dispute, the owners of Tao Restaurant turned to Verrill Dana’s Jim Goggin to protect their business.
Vendor Reinstatement
A New England vendor for a national company called on Verrill Dana’s attorneys to assist them when they were terminated as distributors without cause.
Whistleblower Defense
Representation of an employer in a whistleblower claim based upon reporting illegal activities in which reporting was part of employee’s job duties.
