  • Katie advises clients on all aspects of energy law and regulatory practice before the Federal Energy Regulatory Commission, Maine Public Utilities Commission, and other administrative agencies. She has unique experience in licensing energy self-suppliers and obtaining authorizations for wholesale energy sales and purchases in the New England electricity market. She reviews and analyzes energy contracts, power purchase agreements, and asset purchase and sales agreements; conducts energy-related due diligence in the context of asset deals; drafts petitions, motions, and applications submitted to regulatory agencies; and researches intricate issues affecting electric and water utilities at both the state and federal levels. In addition, Katie edits and writes articles for the Energy Group’s blog, www.energylawupdate.com.

Biography

Katie helps providers and customers of natural gas services, telecommunications services, electric service, and water service achieve their goals before the Maine Public Utilities Commission and numerous other state and federal agencies and state courts.

In the natural gas field, Katie has practiced before the Maine PUC representing both natural gas companies and consumers in a range of cases, including:

•Helping industrial, municipal, and nonprofit consumers of natural gas distribution companies in rate cases.
•In a landmark proceeding, assisted a major interstate natural gas pipeline company in obtaining conditional approval for a multimillion-dollar long-term contract for natural gas pipeline capacity in New England.
•Represented a natural gas LDC in numerous proceedings relating to foundational certifications, cost of gas recovery, marketing, gas-on-gas competition, gas safety, and various other issues.
•Obtained certification of Maine’s first private natural gas pipeline serving a major manufacturing firm.

In the realm of telecommunications, Katie has an active multijurisdictional practice, including:

•Working closely with a leading reseller of prepaid wireless service on matters relating to federal and state Universal Service Fund programs and tax compliance in Maine, Massachusetts, and before the Federal Communications Commission
•Practicing before state regulatory commissions throughout New England on behalf of a national wireless industry trade association, including with respect to USF programs, 911 program budgets, and pole attachments.

In the electric arena, Katie has practiced before the Maine PUC and the FERC on a variety of matters, including:

•Advised an investor-owned transmission and distribution utility in several proceedings before the Maine PUC, including stranded cost rate cases and affiliate transaction approvals.
•Successfully assisted in defending a Maine T&D company against a multimillion-dollar claim for headwater benefits before the FERC.
•Represented a number of clients in obtaining necessary regulatory approvals for two of the largest solar arrays in the State of Maine.

Katie also negotiates, drafts, and analyzes power purchase agreements, asset purchase and sales agreements, interconnection agreements, and other energy-related contracts; conducts due diligence in mergers and acquisitions of energy, telecommunications, and water companies; and drafts petitions, motions, and briefs, submitted to regulatory agencies and courts.

Katie has given presentations on topics including electric distribution ratepayer funding of interstate natural gas infrastructure, funding of natural gas efficiency programs, and natural gas safety.

Katie and her husband, daughter, and son live in Brunswick, Maine.

2012 Summit Natural Gas of Maine Rate Plan
In 2012 and 2013, Bill Harwood and Katie Gray provided counsel to Summit Natural Gas of Maine, Inc., Maine’s newest natural gas local distribution company, before the Maine Public Utilities Commission with regard to Summit’s alternative rate plan, ARP.

Approval of Maine's First Private Natural Gas Pipeline
In 2011, Verrill Dana secured regulatory approval for the state’s first private natural gas pipeline, a direct connection off the Maritimes & Northeast Pipeline serving Woodland Pulp LLC and now represents Woodland Pulp in connection with shared use of the pipeline with another industrial consumer.

Bangor Hydro Electric Company: Headwater Benefits
We represented Bangor Hydro Electric Company in defending a substantial claim before the Federal Energy Regulatory Commission (FERC) for compensation for headwater benefits relating to FERC licensed hydropower projects located along the Penobscot River in Maine.

Bowdoin College Solar Power Generation Project
Verrill Dana represented Bowdoin College in securing municipal approvals to install an underground electric distribution line to serve the College’s new 1.2-megawatt, 4500-panel solar generating project.

Certifications and Approvals for Pittsfield Solar, Which Will Be Largest Solar Farm in Maine When It Goes Into Service
In 2017, Verrill Dana represented Cianbro Development Corp. subsidiary Pittsfield Solar, LLC in obtaining regulatory approvals for a 9.9-megawatt ground-mounted solar array to be located on 54 acres in Pittsfield, Maine.

Hannaford Energy, LLC: New England Power Pool Membership
We represent Hannaford Bros. Co. (Hannaford) in the creation, permitting and licensing of its new energy marketing subsidiary, Hannaford Energy, LLC (Hannaford Energy).

Moody's Collision Center Solar Development
In 2014 and 2015, Verrill Dana advised Moody's Collision Center with respect to its investment in a substantial solar development at Maine Audobon in Falmouth.

Multi-Disciplinary Representation in Mill Purchase and Regulatory Compliance
We represented the buyer in the acquisition of Domtar Maine LLC, which owns and operates the pulp mill in Baileyville, Maine (also known as Woodland), and continue to represent the mill in regulatory compliance matters.

Natural Gas Pipeline Expansion in the Northeast
Since early 2014, our firm has successfully represented a large interstate pipeline company before the Maine PUC in advancing two significant new interstate pipeline expansion projects.

Reclassifying as a FERC-Jurisdictional Transmission Line
In 2010, Madison Electric Works (MEW), an electric utility serving Madison, Maine, explored reclassifying its 115-kV power line as a FERC-jurisdictional transmission line. We advised MEW as to the steps necessary to obtain FERC-jurisdictional status, and researched the regulatory regime under which MEW would find itself were the reclassification to succeed.

Regulatory Approval for Summit Natural Gas of Maine
In early 2013, Verrill Dana secured regulatory approval for Summit Natural Gas of Maine, Inc. to become Maine’s fourth natural gas local distribution company (LDC).

Representation of Large Natural Gas Consumers
Our natural gas attorneys also provide legal counsel to Bowdoin College and other larger consumers of gas.

Solar Energy Development
Verrill Dana has represented solar energy developers and investors related to multiple projects throughout Maine and Massachusetts. We have provided permitting counsel and due diligence on solar projects ranging from a 1.5-MW micro-grid array in Brunswick to a proposed 100-MW project in the unincorporated area of Hancock County.

Verrill Dana represented Diversified Communications in the acquisition of a newly built $2.5 million solar array in Brunswick, Maine.

Solar PPA Negotiation on Behalf of Brunswick, ME Nonprofit
In 2016, Verrill Dana worked with The Gathering Place, a nonprofit organization based in Brunswick, Me., in negotiating a solar power purchase agreement with Maine’s largest solar installation company.

In 2017, Verrill Dana represented North Haven Sustainable Housing in negotiating a solar power purchase agreement with Maine’s largest solar installation company.

Verrill Dana Helps Methadone Clinic Win Local Approval in Sanford, Maine
Verrill Dana has a long history of helping methadone clinics in Maine, having helped permit the very first clinic in the mid-1990’s. In early 2011, a Massachusetts based provider of opiate addiction treatment services approached Verrill Dana for assistance in opening an outpatient Methadone treatment clinic in Sanford, Maine. On October 2nd, 2012, after more than 18 months of work, Verrill Dana succeeded in helping the client win approval from the Sanford Town Council to open a clinic.
