  • Nate Hull’s practice focuses on corporate restructurings, avoidance litigation and bankruptcy-related appellate work. In particular, Nate managed the claims objection process and avoidance litigation for the Chapter 11 Trustee of a bankrupt petroleum marketer and has been the primary associate in connection with bankruptcy-related appeals to the Federal District Court, the Bankruptcy Appellate Panel and the Court of Appeals for the First Circuit. Nate regularly publishes articles on both commercial and consumer bankruptcy theory and practice, with a growing focus on the role mediation can play as a cost-effective alternative to traditional bankruptcy litigation.

Biography

Nate Hull’s practice is devoted to providing sound legal and strategic advice to clients involved in financially distressed situations. His extensive work on behalf of trustee clients has permitted Mr. Hull to develop a widely-recognized practice advising those people entrusted to administer the assets of others. He is also a member of the panel of chapter 7 trustees for the District of Maine.

Mr. Hull and the Firm’s Bankruptcy & Creditors’ Rights Group are honored to have been selected to manage the complex asset sales and wind-downs of several businesses, including what may be the fastest 363 sale in the history of the District of Maine. Mr. Hull has also been entrusted to serve as bankruptcy counsel to creditors’ committees, debtors, secured lenders, critical vendors, commercial landlords, asset purchasers and defendants in many preference and fraudulent transfer actions.

His deep ties to the local bankruptcy community along with the benefits of Verrill Dana’s wide array of resources position Mr. Hull as a true client advocate.

Mr. Hull regularly authors articles for the American Bankruptcy Institute Journal, many of which have been cited in other scholarly publications. He is actively involved with the Maine division of ABI’s Credit Abuse Resistance Education (“CARE”) program, which provides financial literacy resources and classes to high school students and frequently publishes and lectures.

Experience

Chapter 7 Representation of Trustee
A converted Chapter 11 case for two debtors who together employed several hundred employees. The largest secured creditor was owed approximately 30 million.
Eucalyptus Plantation Purchase
We represented the purchaser in the acquisition and financing of a eucalyptus plantation in Hawaii and the negotiation of a biomass supply agreement.
In re Interep National Radio Sales, Inc., et al.
In this case, Verrill Dana defended multiple parties against preference claims and was able to resolve the matters for approximately 25% of the demand.
In re NewPage Corporation
Verrill Dana represented a Maine-based trade supplier in securing “critical vendor” status in this Delaware bankruptcy case.
In re Smurfit-Stone Container Corporation, et al.
Verrill Dana represented a Maine-based trade supplier in asserting administrative claims against the debtor’s estate pursuant to section 503(b)(9) of the Code and favorably resolved the debtor’s resulting objection.

Secured approval for a 363 sale in only 26 days from our selection as Trustee’s counsel.
Sale of M.W. Sewall Co.
The collaborative efforts of the Bankruptcy Department, the Business Law Department and the Real Estate Department resulted in the successful sale of substantially all of the operating assets of M.W. Sewall and Co. The case presented a particularly complex fact pattern and required an expedited sale process in order to allow the assets to be sold while they still had value.
Timberland Acquisition and Sale of Conservation Easement
We provided representation of a purchaser in the acquisition of commercial timberland and the sale of a conservation easement in Monroe County, Alabama.
