  • Seth S. Coburn joined Verrill Dana as an associate in 2011. He received his law degree from Boston College School of Law, where he graduated cum laude. It was there that Seth refined his advocacy skills through participation in multiple moot court competitions including the national J. Braxton Craven Constitutional Law Moot Court Competition. While in law school, Seth also served as a legal intern for Judge Kermit V. Lipez of the U.S. Court of Appeals for the First Circuit as well as for Prisoners’ Legal Services in Massachusetts. In addition, Seth served as the Research Editor for the Uniform Commercial Code Reporter-Digest.

    Seth graduated magna cum laude from Hamilton College in 2006 with a Government Concentration. Prior to attending law school, Seth worked as a paralegal for the Federal Trade Commission’s Bureau of Consumer Protection in Washington, D.C. When he is not at his desk, Seth, a Maine native, can be found hiking and skiing in the mountains of Maine or working on his developing culinary skills.

Seth primarily represents clients in complex intellectual property disputes across a range of industries and technologies. Seth works to understand each client’s business and goals to develop and execute the most effective strategy, whether that involves pre-litigation negotiation, administrative action before the United States Patent and Trademark Office, or litigation.

Seth has assisted clients in patent disputes in high tech fields such as telecommunications, software, and solid-state lighting, in courts such as the Eastern District of Texas, the District of New Hampshire and the District of Massachusetts. Seth is experienced in developing infringement and validity analyses, developing damages theories as well as developing, briefing and arguing Markman. Seth also has experience providing strategic pre-litigation counsel, including pre-suit risk analysis and developing risk-mitigation strategies.

In addition to his patent work, Seth also has experience assisting clients protect and manage their brands. Seth’s experience runs the gamut of trademark disputes: from complaint, motion practice, summary judgment through trial. Seth has represented clients in the hospitality, beverage and nutritional supplement industries in trademark disputes before courts in New York, Michigan, Massachusetts and Maine. He has also litigated disputes over trademark registrations before the Trademark Trial and Appeal Board.

In addition to his intellectual property work, Seth has represented clients in matters before state and federal courts involving product liability claims, contract disputes, claims of unfair trade practices, as well as real estate and probate disputes.

Seth also has experience before a variety of appellate courts. Seth has also assisted in appeals before the United States Court of Appeals for the Federal Circuit, United States Court of Appeals for the First Circuit as well as multiple appeals before the Maine Law Court. Seth’s appellate experience involves matters such as venue, breach of contract, professional licensing, business interference claims and claims against fiduciaries, as well as property rights.

When he is not at his desk, Seth, a Maine native, spends much of his time hiking and skiing in the mountains around New England.

Fighting a Patent Troll - and Winning
When software company SlickEdit Inc. was sued by a patent assertion entity (i.e. a “patent troll”) in the Eastern District of Texas, it could have settled the matter - like so many defendants before it - by writing a large check.
