  • Tim Shannon is a trial and appellate attorney representing high-tech companies, inventors, and patentees in complex commercial litigation, patent disputes, and other high-stakes litigation. He primarily represents mid-sized and large corporations in federal district court patent litigation and on appeal to the Federal Circuit. In parallel, in his commercial litigation practice, he represents a variety of companies in the energy, manufacturing, and transportation fields. He has represented a range of companies in patent litigation emphasizing medical devices but also encompassing a range of other technologies. He has represented an international medical device manufacturer in a patent dispute involving six patents covering methods and devices for human spinal fixation. He has represented another medical device manufacturer in a patent dispute concerning computer-assisted pap smear screening. He has helped appeal and reverse a $250 million jury verdict; his portion of the brief alone recovered nearly $80 million for the client. Along the way, he has also participated in several significant Markman hearings, most recently arguing claim constructions in the District of Maine. In parallel with this patent litigation, Tim has represented a variety of companies in complex commercial disputes. He has represented an international energy company in a complex contract dispute, and is currently representing a Maine-based railroad company in an international lawsuit.

Biography

With clients from Shanghai to Toronto to California, Tim Shannon maintains a national intellectual property litigation practice in a variety of high-tech fields, with a particular focus on patents and patent “troll” litigation. Tim’s practice involves extensive work in the software, electronics, lighting, computer chip manufacturing, and medical device fields. His complaint-to-trial experience includes Markman hearings in courts across the country, from Massachusetts to Texas. Recent highlights include:

•Representation of a Shanghai-based computer chip manufacturer, through Markman and settlement, in a patent troll case in E.D. Tex.
•Representation of a North Carolina-based Integrated Development Environment software manufacturer in a patent troll case in E.D. Tex.
•Representation of a Toronto-based life sciences company specializing in plant-based manufacturing/gene expression of human monoclonal antibodies.
•Representation of a national LED lighting company in extensive patent licensing negotiations and pre-suit investigation against a 200-patent portfolio.

Clients have entrusted some of their most difficult and technologically-sophisticated cases to Tim and his team. In the words of one client:

Prior to joining Verrill Dana, Tim practiced in the #1-ranked IP litigation practice group at WilmerHale. While there and since, Tim has handled patent cases involving a wide range of technologies, including software, data- and telecommunications, online banking, computerized mammogram screening, controlled fluid delivery in medical devices, spinal fixation, and blood glucose testing.

Tim also maintains a substantial pro bono practice, most recently representing a teenage boy in an appeal to the Maine Supreme Judicial Court concerning a family matter. He has previously represented Algerian-born detainees held at Guantanamo Bay (“GTMO”) seeking transfer out of GTMO.

When not practicing law, Tim is active in local, state, and federal politics. He serves on the Hillary for Maine Finance Committee and is a former member of the Obama for Maine Finance Committee. He is chairman of the Yarmouth Town Democratic Committee. He is the President Elect of the Federal Bar Association of Maine and - most important - a devoted husband and father of two fantastic kids.

Appeal of Patent Dispute
Represented a large medical device manufacturer in an appeal of a 250 million jury verdict in patent on grounds concerning ensnarement, lost profits, and the trial court’s misunderstanding of the “reverse doctrine of equivalents.”
Complex Contract Dispute
We represented the U.S. division of a large international energy company in a complex contract dispute with its largest Massachusetts customer, a power station.
Computer Based Banking Patent Dispute
We represented the U.S. division of a large international bank, in both federal District Court and on appeal to the Federal Circuit, in a patent dispute concerning computer-based banking transactions.
Fighting a Patent Troll - and Winning
When software company SlickEdit Inc. was sued by a patent assertion entity (i.e. a “patent troll”) in the Eastern District of Texas, it could have settled the matter - like so many defendants before it - by writing a large check. SlickEdit decided: no. It didn’t infringe. It wasn’t going to settle. It hired Verrill Dana.
Gifford’s Dairy: Trademark Infringement
We represented a long time Maine family ice cream manufacturer in a trademark infringement case against a Maryland ice cream manufacturer in US District Court.

We represented a large medical device manufacturer in a six-patent dispute involving nearly a dozen accused medical devices.
