• Ohio Supreme Court Upholds Products Liability Statute of Repose and Workers' Compensation Subrogation Statute

  • The Ohio Supreme Court has issued another decision upholding tort reform measures passed by the Ohio General Assembly. The decision in Groch v. Gen. Motors Corp., Slip Opinion No. 2008-Ohio-546, issued on February 21, 2008, held that the products liability statute of repose and workers' compensation subrogation statute were both constitutional. This applies to cases where a claimant's injury occurs during the two years preceding the April 7, 2005 effective date of the statute of repose and the claimant files suit within the two-year statute of limitations, however, the statute of repose cannot be applied to extinguish the product liability claim.
