Biography

George Bodenger has over 25 years of experience representing healthcare providers, pharmaceutical companies and medical device manufacturers in a wide variety of regulatory, transactional and government litigation matters. He has significant experience defending healthcare providers, vendors and suppliers in disputes with federal and state enforcement agencies. George also has an extensive background in negotiating and structuring business arrangements among and between hospitals, health systems and physicians. George has also handled numerous payer-provider reimbursement-related issues during his career, including Medicare and Medicaid reimbursement disputes. In addition, George has assisted healthcare and life science organizations of all types and sizes in the development, implementation and monitoring of corporate compliance programs. He also handles Medicare/Medicaid payment matters. In addition, George has considerable experience in negotiating participating provider agreements with non-governmental insurers for health systems, hospitals, and large medical practices.

From 2005 through 2015, George was a Partner at Saul Ewing, LLP and served as Chair of the Firm’s Healthcare Practice. Prior to his tenure at Saul Ewing, George was a Partner in the Health Law Practice of Duane Morris, LLP. Before entering private legal practice, George worked for several years at Ernst & Young in the firm’s healthcare auditing and management consulting practices, specializing in strategic planning, financial feasibility studies, forensic accounting, valuations and Medicare/Medicaid reimbursement.

George’s first career in public accounting and management consulting complements his legal practice. George brings significant added value to his clients with this unique combination of skills, and he is very adept at helping clients to achieve their business goals while maintaining compliance with relevant federal and state laws and regulations.

George is very active in civic activities. He is a Board member and former Executive Committee member of the Anti-Defamation League, whose mission is to fight Anti-Semitism and other forms of bigotry and hatred through education and advocacy at local and national levels. George is also a member of the Board of Trustees of Peter’s Place, a non-profit organization that provides group bereavement counseling to children who have lost a parent or sibling. George is a past Board member and Treasurer of Family Support Services, a non-profit organization that combats child abuse in the City of Philadelphia.

Experience

• Defending health care providers under federal and state investigation in Anti-Kickback, Stark, “qui tam” and other similar actions, including voluntary disclosures in connection with U.S. Department of Health and Human Services – OIG Voluntary Self-Disclosure Protocol.

• Providing advice and counseling to hospitals, physicians and other providers regarding the interpretation of the HIPAA and HITECH regulations and the implementation of the privacy and security rules.

• Representing hospitals and physicians in various commercial arrangements including joint ventures, practice acquisitions, recruitment arrangements, and other types of clinical integration transactions in numerous medical and surgical specialties, which satisfy Stark and Anti-Kickback requirements.

• Assisting pharmaceutical and medical device companies in structuring business arrangements with physicians and hospitals providing Stark and Anti-kickback statute compliant incentive programs.

• Performing compliance program risk assessments and effectiveness reviews for healthcare providers and medical device manufacturers with respect to “core” health care laws and regulations, including Anti-Kickback, Stark, HIPAA and the Sunshine Act.

• Assisting a wide range of healthcare providers in the negotiation of third-party payer contracts with major commercial insurers, for a broad range of insurance products such as commercial, HMO, Medicaid managed care and Medicare Advantage.
