- The Regulation to amend the Regulation respecting mandatory lease forms and the particulars of a notice to a new lessee will come into force on February 24, 2015 and will alter the mandatory lease forms for private seniors’ residences in Québec.
Effective on February 24, 2015, it will no longer be possible to use the former lease forms and property owners, including seniors’ residences will be required to use the new forms for all new lessees. As specified on the website of the Régie du logement, the present lease forms will nevertheless remain valid until they are no longer renewed. It will therefore not be necessary to have new leases signed by current lessees.
The Main Changes Applying to Seniors' Residences
Schedule 6 to the lease, entitled "Services Offered to the Lessee by the Lessor", must henceforth include a list and a description of the services of a personal nature to be provided to the lessee and specify the part of the rent that relates to the cost of each of those services.
The notice to the new lessee provided for by Article 1896 of the Civil Code of Québec, which indicates, in particular, the lowest rent paid in the 12 months preceding the beginning of the lease, must henceforth also include any changes made to the services of a personal nature to be provided to the lessee.
Schedule 6 to the lease has also been amended so as to specify several rules of the Civil Code of Québec applying to seniors’ residence, including the costs which may be claimed in certain cases of resiliation of leases.
Availability of the New Leases
As stated on the website of the Régie du logement, the new mandatory lease forms should be available as of February 24, 2015 in the offices of the Régie du logement, as well as in the different sales outlets of Les Publications du Québec. Their sale price remains $1.99.
