  • The 8th U.S. Circuit Court of Appeals recently reversed a lower court's summary judgment originally decided in favor of a retailer/employer. On reversing, the Court found disputed issues of fact that could lead a jury to find the employer liable for the discriminatory conduct of its salesperson under 42 U.S.C. ยง1981. Green v.
