  • On April 7, 2010, the Securities and Exchange Commission (“SEC”) unanimously approved for public comment a series of new proposals which, if they are adopted, will revise Regulation AB and other rules relating to public and private offerings of asset-backed securities (“ABS”). The proposed rules set forth in the SEC’s proposing release (the “Release”) would modify the disclosure and other requirements for the SEC’s Regulation AB, promulgated in 2006, for public offerings of ABS and, for the first time, would also impose disclosure and other requirements for Rule 144A and Regulation D offerings of ABS.
