  • On April 10, 2007, the Treasury Department and Internal Revenue Service issued long-anticipated final regulations under Section 409A of the Internal Revenue Code, which was added to the Code to address perceived deficiencies in the taxation of deferred compensation. The regulations -- which together with an explanatory preamble are nearly 400 pages in length -- answer many questions that have been of concern to employers and their advisors, although certain critical issues were left for additional regulations to be issued in the future.
