It is so commonly charged in Virginia, because it is very easy to violate the Commonwealth's reckless driving law.Anyone caught driving 80 miles per hour, or 20 miles-per-hour over the speed limit can be found guilty of reckless driving. While jail time is fairly rare in these cases, the possible repercussions of a misdemeanor conviction make this a serious charge in Virginia. Jay also handles many Virginia DUI cases for Scrofano Law.Like Reckless Driving, DUI in Virginia is also a class one misdemeanor and carries the same maximum jail sentence of 1 year.
