Judith Wheat is an accomplished trial lawyer who has received AV Preeminent peer review ratings in Martindale-Hubbell, and has been recognized as a 2010 and 2011 Washington, D.C. Super Lawyers. Ms. Wheat assists corporate and individual clients in employment litigation, complex civil litigation, and criminal investigation and defense. Her clients include government employees, private sector executives and managers, government contractors, physicians, health care providers, law firms, and numerous small and medium-sized businesses. Because criminal investigations frequently have consequences outside the court system, including employment actions, parallel civil proceedings, and suspension and debarment actions, Ms. Wheat has a wide breadth of experience handling these types of matters as well.

Ms. Wheat has over 17 years experience representing businesses and individuals in all facets of litigation including criminal investigation and defense. Her experience includes conducting internal investigations for businesses, ranging from Fortune 100 companies to sole proprietors. She has represented both individuals and corporations in federal grand jury investigations and federal administrative proceedings. She has tried numerous criminal cases in both federal and state court and is adept at plea negotiations and sentencing strategy. Ms. Wheat has also handled employment matters and complex civil matters from the initial complaint to subsequent litigation.

Some of Ms. Wheat’s successes include:

-Not guilty verdict on all counts in the U.S. District Court for the Southern District of New York for a US Secret Service Laboratory Director charged with perjury and obstruction of justice for testimony provided in the trial of Martha Stewart;

-Not guilty verdicts by a D.C. Superior Court jury for a hospital employee charged with 15 counts of sexually assaulting two patients;

-An acquittal by a Virginia judge for an FBI agent charged with assault and battery;

-A not guilty verdict by a D.C. Superior Court judge for a former government employee charged with indecent exposure and indecent sexual proposals in the workplace;

-A defense verdict by a federal jury in Miami for a corporate client accused of violating federal false advertising laws and related civil claims.

Over the years, Ms. Wheat has guided numerous clients through the federal grand jury and administrative agency investigative process. Working with qualified investigators, forensic specialists, and other experts, she has been able to assist clients in formulating strategies to achieve the most favorable result, including, in some cases, avoiding prosecution altogether. Ms. Wheat has also assisted government employees in administrative and disciplinary actions and helped private sector employees negotiate separation, severance, and consulting agreements. Ms. Wheat currently serves as Legal Counsel to the Clerk of the Arlington Circuit Court.

Prior to owning her own firm, Ms. Wheat was a partner at some of the area’s leading law firms. Ms. Wheat is a former co-chair of the D.C. Bar Criminal Law and Individual Rights Section and former President of The Barristers. She has been a faculty member at both the NITA Intensive Trial Advocacy program and at the NITA deposition program. Ms. Wheat speaks Spanish.
