Reported Cases:
Representation of financial services clients in connection with environmental claims arising out of mortgage transactions and Other Real Estate Owned properties *** Representing a major bank, successfully defended a case which resulted in the first published opinion under New Jersey's Elder Financial Abuse Statute. The plaintiff filed suit against the bank and its employee alleging that the statute required financial institutions to report suspicions of elder abuse to state authorities. At trial, the Court determined that the statute imposes no duty on financial institutions to make such reports, and that the statute provided no private cause of action against financial institutions for failing to make such a report. *** Represented the plaintiff, a leading developer of residential properties, in litigation related to a multi-million dollar real estate deal. Ms. Reckord's work on the matter involved a successful application to the Appellate Division regarding the pre-mature grant of summary judgment for the defendants by the trial court, which resulted in a reversal. *** Successfully represented an insurance brokerage firm in litigation related to an exclusive insurance agency agreement. This case involved both injunctive relief in the District Court of New Jersey and the Third Circuit Court of Appeals and a 9-figure damages claim in arbitration. Successfully defended a leading auto finance lender in a class action litigation regarding its actions in connection with the repossession of vehicles. The case involved technical claims under the Uniform Commercial Code, Consumer Fraud Act and Truth in Consumer Contract Warranty and Notice Act.
