Mr. Nudelman concentrates his practice in construction law. For over two decades he has represented members of the construction industry across a broad spectrum of matters. He has defended and asserted claims on behalf of owners, developers, condominium associations, general contractors, design professionals, subcontractors, vendors and sureties involved in public and private construction projects throughout the New Jersey and New York metropolitan area.

Mr. Nudelman has extensive experience handling construction claims related to a wide range of issues. These include payment disputes, change orders and extra work, construction defects, design and performance defects, errors and omissions/professional malpractice, building code violations, project management, delay and disruption, acceleration, liquidated damages, lost productivity, site conditions, warranties, project closeout, construction liens, municipal mechanic’s liens, condominium liens, payment and performance bonds, public contracting and violations under the New Jersey Consumer Fraud Act.

In the niche practice area of community association law, Mr. Nudelman represents associations, unit owners and developers in the above matters, as well as in disputes involving budgets, financing and condominium governance.

Mr. Nudelman’s expertise encompasses the representation of clients who receive code violations lodged by state or local enforcement officials under the New Jersey Uniform Construction Code Act, defending them in proceedings in municipal court and before the Construction Board of Appeals and the Office of Administrative Law. He has also appeared on behalf of clients in state, federal and appellate courts and in local and international mediations and arbitrations.

Understanding that a well-drafted agreement is critical to minimizing claims and disputes, Mr. Nudelman assists construction industry clients with contract drafting, review and negotiations, with an emphasis on efficiency and practical results.

In the area of real estate litigation, Mr. Nudelman has experience in title defense matters. He has represented owners and lenders in title insurance claims and has prosecuted and defended quiet title actions and cases involving trespass, easements, boundary disputes, adverse possession, equitable subrogation and title defects.
