  • Carriers, third-party administrators and defense practitioners are often presented with situations where cancelling a workers’ compensation policy is prudent. This may occur when an insured has fallen behind on premium payments, or has failed to make any payments altogether. In order to cancel a policy, a carrier must comply with Section 81 of the New Jersey Workers’ Compensation statute, which governs the cancellation of a policy. Failure to comply with Section 81 will result in a decision adverse to the carrier.
