  • The last issue of this column discussed Hamby v. Profile Products, L.L.C., 179 N.C.App. 151, 632 S.E.2d 804 (2006), in which a divided North Carolina Court of Appeals found that the exclusivity provisions of the Workers' Compensation Act were not an absolute bar to recovery against Profile Products, L.L.C., the sole member of Terra-Mulch, L.L.C., in connection with the plaintiff's injuries arising out of employment with Terra-Mulch.
