• Pre-Existing Deformities Not Compensable

  • The S.C. Court of Appeals recently held that a radiation therapist did not suffer a compensable injury by accident where prolonged standing on her feet aggravated pre-existing structural deformities in her feet. In so doing, the Court of Appeals re-affirmed prior case law providing that if an employee essentially knows the job is going to cause the worsening of a pre-existing condition, the worsening is not a compensable injury by accident as it is “expected” from the standpoint of the employee.
