  • The Internal Revenue Code (the "Code") and the Employee Retirement Income Security Act of 1974 ("ERISA") require that employers who maintain certain qualified and nonqualified retirement plans and welfare benefit plans for their employees file Form 5500 annual reports with the Internal Revenue Service ("IRS"), which the IRS then shares with the DOL. While most employers are aware of filing requirements for qualified retirement plans, many employers are not aware that Form 5500s are required for welfare plans such as medical, life and disability plans and for nonqualified retirement plans, including individual deferred compensation agreements between an employer and an employee.
