| Biography | Angela is an associate in the Environmental and Natural Resources Practice Group. She represents corporations in environmental litigation matters, environmental due diligence for asset acquisitions, and regulatory compliance and permitting under various environmental regulatory schemes, with a focus on the Clean Air Act, the Toxic Substances Control Act, the Federal Insecticide, Fungicide, and Rodenticide Act, the Emergency Planning and Community Right-to-Know Act and state counterparts.
Representative Experience
TSCA Compliance: Advising chemical manufacturers on compliance with TSCA as well as the applicability of exemptions to TSCA such as the polymer, test marketing, and research and development exemptions.
Clean Air Act Litigation: Representing major southeastern utility in defending an EPA Clean Air Act New Source Review enforcement action.
Due Diligence; Endangered Species Act: Represented utility in due diligence evaluation of acquisition of solar power generating facility, focusing on National Environmental Policy Act and Endangered Species Act (and state counterparts) requirements and implications.
Clean Air Act Compliance: Advising large southeastern utility annually on potential Clean Air Act New Source Review permitting implications for all capital and significant maintenance projects.
TSCA Enforcement: Represented chemical manufacturer during EPA audit and assisted with negotiation of consent order for alleged TSCA reporting violations discovered during the audit, including successful dismissal of allegations regarding failure to submit substantial risk information to the agency under TSCA Section 8(e).
FIFRA Enforcement: Assisted pesticide manufacturer with responding to EPA information request regarding alleged failure to register a pesticide under FIFRA.
Emergency Response Planning: Assisted chemical manufacturer in responding to allegations of violations of Clean Air Act Section 112(r) Accidental Release Prevention Requirements and revising Risk Management Plan.
