Bad Faith and Extra-Contractual Liability

Insurance affects everyone, and the existence or lack of coverage can greatly impact the outcome of any claim or case. Cole, Scott & Kissane, P.A. is adept in counseling clients in the intricacies of insurance policies and insurance coverage, negotiating the resolution of disputed coverage claims or litigating insurance coverage and “bad faith” issues arising from diverse matters as common law and statutory claims, first-party claims and third-party claims.

CSK holds vast experience in consulting, guiding and defending all types of clients in potential or actual bad faith claims, including direct claims against adjusters, and claims against primary and excess carriers.  CSK’s nationally recognized bad faith attorneys have published national articles or lectured widely on bad faith.

Representing clients in both the private and public sector, CSK assists clients in analyzing a client’s insurance policies to determine if the insurer has a duty to pay for a client’s defense and/or indemnify the insured with respect to any adverse judgments or damage awards arising out of a claim or lawsuit; tendering all claims (where appropriate) on behalf of a client to the appropriate insurer; assisting a client in assessing insurance needs; and asserting a client’s rights under the policy and relevant law through litigation.
