Biography

Jack Pirozzolo is a trial litigator with 45 years of experience trying complex cases to courts and juries in state and federal courts throughout the United States. He has tried numerous antitrust and trade regulation cases, but also represents clients in intellectual property, insurance and general business controversies. Jack has also handled major malpractice, product liability and construction litigation.

Intellectual property disputes that Jack has tried focus on patents for products ranging from electronics to sporting goods. He has protected clients against domestic and foreign infringers in forums ranging from the federal district and appeals courts to the International Trade Commission and the Board of Patent Appeals and Interferences, and a number of his cases involved precedent-setting issues. In addition to patent litigation, Jack has also been involved in litigating infringement of artistic works.

Jack also has substantial experience in insurance coverage litigation, particularly litigation involving insurance coverage of environmentally impaired industrial sites and Superfund sites.

Prior to joining Foley Hoag LLP, Jack was a founding partner of a Boston law firm that focused on patent, antitrust, trademark and copyright litigation. Following law school graduation he served as law clerk for the Hon. Robert C. Zampano, U.S. District Court, Connecticut.

Representative Experience

The following is a brief summary of Jack's experience and accomplishments:

· Acted as counsel in Conceptual Engineering Associates, Inc. v. Aelectronic Bonding, Inc., one of the few cases in which a defendant in a patent infringement case was awarded antitrust damages for patent misuse

· Was counsel in Fisons Horticulture, Inc. v. Vigoro Industries, Inc., which established the doctrine of reverse confusion in the Third Circuit

· Handled the landmark case of Atlantic Thermoplastics Co., Inc. v. Faytex Corp. at trial and through appeals to the Federal Circuit and a related appeal before the Board of Patent Appeals and Interferences

· Served as counsel for The Read Corporation in Read Corp. v. Portec, Inc., and many other cases in a patent program to protect the Read Screen-All from domestic and foreign infringers

· Tried Christian v. Mooney, which paved the way to the end of the ancient doctrine of champerty in Massachusetts

· Received, in Murray v. Shaw Industries, Inc., a verdict for an award of the full amount of compensatory and punitive damages for the infringement of the artistic work of Claire Murray and was complimented in the court record for the reasonableness of the fees charged

· Handled multiple infringement cases to deter infringement of accessories for the Nintendo Game Boy.

· Handled the challenge to the Prince tennis racket patent in the International Trade Commission
