Practice/Industry Group Overview

Jenner & Block has a highly successful appellate practice before the United States Supreme Court, the United States Courts of Appeals, and state supreme and appellate courts.  Our lawyers have argued numerous cases before the United States Supreme Court, including 15 cases in the past five terms alone, making the Jenner & Block one of the most active law firms before the Court.

We are also active at the appellate and supreme court levels both in cases in which we represented clients in the lower court and in cases where we have been brought in specifically for our appellate and supreme court proficiency.  We have been supreme court counsel for a wide variety of clients, presenting a broad range of constitutional and statutory claims and defenses.

We have also enjoyed an extensive amicus practice before the Supreme Court.

Jenner & Block also has a highly respected appellate practice, both in the federal courts of appeals and in state supreme and appellate courts.  Among our attorneys are a former Chief Justice of the Illinois Supreme Court, 10 former United States Supreme Court clerks, numerous former United States Court of Appeals clerks and state appellate court clerks, members of the bars of every United States Court of Appeals and members of state bars throughout the country.

In the October 2005-06 Term, the Firm argued in three cases before the Court:  Jackson v. Perry et al, where the Court reviewed a controversial Texas congressional redistricting plan, and in Howard Delivery Service, Inc. v. Zurich American Insurance Co., where the Firm presented argument that priority should be given to claims for unpaid workers' compensation payments in a closely-watched bankruptcy case; and Wagnon v. Prairie Band Potawatomi Nation, where the Firm presented argument in favor of the autonomy of Native American tribes to tax the fuel sold on a reservation to generate revenues to improve roads and bridges.

Other recent U.S. Supreme Court matters include:

MGM Studios, Inc. v. Grokster:  Represented every major U.S. motion picture studio and record company in landmark copyright case involving the issue of contributing liability for companies that operate Internet file sharing services that promote the unauthorized copying of copyrighted music and movies.  Merits Brief | Reply BriefArgument Transcript

General Dynamics Land Systems, Inc. v. Cline:  Represented General Dynamics in a labor relations case that was a significant victory for the company in which the Court ruled that the Age Discrimination in Employment Act (ADEA) was not intended to address younger workers' allegations of employer discrimination that favored older workers.  Merits Brief | Reply Brief | Argument Transcript
