Practice/Industry Group Overview
The White Collar Criminal Defense and Counseling Practice is principally responsible for counseling and defending clients of the Firm who have been victimized by or implicated in alleged violations of a broad array of civil, criminal or regulatory provisions. We commonly represent corporations, as well as their officers and directors, in connection with investigations of potential wrongdoing by grand juries and regulatory authorities. We regularly advise corporations as to the most effective means to mitigate the impact of any detected misconduct, and to implement or modify corporate compliance programs to minimize the likelihood of recurrent problems.
Although we attempt to negotiate favorable resolutions wherever possible, we vigorously defend our clients at trial when it is in their best interests to do so. The practice includes two former United States attorneys and several former Assistant United States attorneys, each of whom has extensive experience in defending grand jury investigations and in assuming primary responsibility for the defense and trial of criminal, qui tam and other litigation. Our attorneys have significant experience in assisting clients with respect to matters relating to anti-trust, health care fraud and abuse, government contracting, political corruption and related ethical matters, federal food and safety regulatory compliance, securities fraud, criminal tax investigations and False Claims Act defense.

- Conducting internal investigations on behalf of some of the nation's largest corporations, as well as state and municipal bodies.
- Counseling corporate clients on the most appropriate means to redress and mitigate the consequences of prior employee misconduct, and to implement an effective compliance program to minimize the likelihood of future misconduct.
- Representing corporate and individual clients in defense of or in relation to grand jury and other governmental investigations.
- Representing corporate and individual clients at trial in defense of criminal and/or civil charges, including numerous qui tam claims filed under the False Claims Act.
- Handling appellate litigation: as the Firm has one of the preeminent appellate practices in the nation, we are frequently sought out for assistance in bringing petitions for certiorari or submitting amicus curiae briefs in the United States Supreme Court and state supreme courts on a wide range of issues.
