Biography

JESSE S. VOGTLE, JR. presently serves on the Firm's Executive, Compensation, and Recruiting Committees, and is Chairman of its Creditors Rights and Bankruptcy practice group. He specializes in creditors rights, bankruptcy and commercial litigation, real estate and loan workouts, and loan sales. 2012 work includes helping Banks prosecute loss/share loans purchased from the FDIC and loan sales through brokers and one-off transactions. In 2011, the practice group sold loans for banks in excess of one billion dollars ($1,000,000,000). Jesse's practice is devoted primarily to helping banks and all forms of secured and unsecured creditors navigate the bankruptcy process nationwide. Jesse specializes in complex bankruptcy litigation related to chapters 7, 9, and 11, including fraudulent conveyance, preference, asset sale, loan modification, landlord/tenant, real estate mortgage and lien priority disputes, deepening insolvency theories, lender liability defense, intercreditor disputes between participants and syndicated lenders, and collateral liquidation. Jesse is a member of the firm's Credit Crisis Group, a special team of lawyers working on challenges created by the current disruptions in the credit and other capital markets.

Last year, Jesse served as Immediate Past Chairman of the Executive Board, Bankruptcy and Creditors Rights Section of the Alabama Bar Association, and served as Master of Ceremonies at Alabama's 2011 bankruptcy seminar "Bankruptcy at the Beach". He is Past Chairman of the Task Force to Evaluate Alabama State Bar Section Financial Management. He served as Chairman, Bankruptcy and Commercial Law Section of the Birmingham Bar Association, and is a past member of the Executive Committee, Birmingham Bar Association. Jesse served as the Firm's hiring partner from 1998-2002, and was elected to the Management Council for a two-year term (2001-2003) "Under 10 Position". From 2009-2011, Jesse spearheaded Balch & Bingham's United Way campaign (2009-2011). He served on the Firm's Practice Development Committee with responsibilities for the Birmingham market.

Representative Experience

· Jesse has 24 years experience providing Banks and creditors advice regarding business bankruptcies, commercial and real estate loan workouts and collateral preservation and liquidation. Jesse's work in the last several years includes:

· Loan sales from Banks appreciating one billion dollars ($1,000,000,000) in loan value

· Advising Banks on asset purchases from FDIC

· Prosecution of Loss/share workout portfolios for Banks acquiring loans from the FDIC under government guaranty programs

· Real estate loan workouts in Alabama, Florida, Mississippi, and Louisiana requiring completion of vertical construction to preserve collateral value.

· Represent lender as participant in $500,000,000 unsecured credit line concerning Nevada real estate adversely impacted by subprime mortgage meltdown.

· Represent lender in multi lender workout involving beach real estate, formation of collateral pool to fund interest reserves for all lenders.

· Represent venture fund in foreclosure and subsequent sale of condominiums, houses, retail, and commercial spaces.

· Defend lender against counter claims alleging fraud, misrepresentation, and forgery related to interest rate swap agreements.

· Defend lender in bankruptcy action seeking to reverse monies pleged to letters of credit.

· In re: The Capri Condominiums Limited Partnership ( US Bankruptcy Court, Middle District of Florida, case no. 8:08-bk-01553 ), representing lead bank in successful transfer of chapter 11 case from Tampa, FL to Birmingham, AL, involving $27,000,000 participated credit secured by single asset condominium development located in Alabama

· Representing lender in $22 million real estate mortgage workout, on condominium development in Destin, Florida

· In re: Citation Corp (AL), -- represented air plane engine manufacturer in bankruptcy proceeding seeking res judicata ruling from bankruptcy court impacting related litigation in PA, FL, OH, and AL based on non-final jury verdict rendered in TX trial court for $90,000,000

· Representing lender in loan modification for defaulted construction loans with possible fraudulent conveyance issues, in Gulf Shores, Alabama
