old Complex Commercial Litigation

Kilpatrick Stockton's commercial litigation attorneys understand, and realize that from our largest to our smallest business clients, everyone wants lawyers who can aggressively help them achieve their revenue enhancing litigation objectives, and who can also provide solutions to help manage the expenses associated with commercial litigation. To this end, we provide clients with both legal expertise in all types of commercial litigation and practical experience in controlling the expense side of the equation, as both are critical to achieving results on the bottom line.

A reality of modern global commerce is that the courts are no longer a business forum of last resort. Rather, competitive advantages are won and lost every day in the courtroom, not in the marketplace. These days, many companies routinely use litigation -- or the credible threat of litigation -- to reinforce their research, manufacturing, marketing and other commercial efforts. As a result, our clients' economic success depends in part on their ability to adapt and thrive in this increasingly hostile global business environment. This is where our firm's legal experience and business focus give them an edge. There are many ways to define victory in a commercial dispute. However, a win at the courthouse at the expense of a win in the marketplace is not our definition of success.

From the moment we are retained in a commercial dispute, our attorneys strive to understand the client's unique business environment, as well as the dispute itself, allowing us to offer the client an integrated set of legal and business solutions. Providing these solutions sometimes means that we take a case to trial, sometimes to arbitration and sometimes to the negotiating table. Often it means avoiding litigation altogether through preventive counseling, employee training and early dispute intervention.

Whatever the situation, our lawyers seek to perfectly harmonize our legal strategy and your business goals through close and constant communication between the litigation team and the client's leadership. Effective communication allows us to deploy resources appropriately and to deliver "client-focused" results efficiently. Whether we are assisting in eliminating the risk and negative consequences of a failed venture or removing obstacles in avenues of future commercial growth, we are always looking for innovative ways to managing both the ongoing cost of routine business litigation and the extraordinary expense associated with a large one-of-a-kind dispute.

While we do everything possible to assist the client's business objectives and to manage litigation expenses, exceptional skill in the courtroom is always our first order of business. Many of our attorneys have significant experience trying and arbitrating large and small business cases in the U.S., and around the world. Every day, our firm represents some of the world's most respected and well-known companies in large and small commercial cases involving complex motions practice, voluminous documents and sensitive depositions. Similarly, we also represent individuals and, as yet unknown, start-up ventures in commercial cases that are smaller but no less critical to those clients. We are leaders at the bar and our ranks include lawyers recognized for their trial advocacy skills by the Inns of Court and the American College of Trial Lawyers. Whatever value our other efforts may add, we are first and foremost aggressive, skillful and ethical advocates for our clients.

Diversity

The firm's commitment to diversity as a core value leads us to pursue initiatives that make every aspect of our work environment more open and fulfilling for everyone. We have adopted as our guiding principle the following statement about what diversity means to us, which we refer to as the Kilpatrick Townsend diversity principle:

"At Kilpatrick Townsend, all persons, without regard to differences among them that do not matter in the workplace, shall be respected and valued fully, so that each person may maximize his or her potential to contribute to the common good of our firm and to benefit fairly from doing so."

Our Legacy

Kilpatrick Townsend has a 135-year history of leadership in inclusiveness -- hiring and promoting diverse attorneys and staff and fostering an environment in which the best legal minds can thrive. It's one of the most important elements of our legacy, and it has contributed directly to our firm's success.

Kilpatrick Townsend:

  • was one of the first large firms in the Southeast to have a female partner;
  • led the major regional law firms in recruiting and hiring African-American attorneys
  • was the first AmLaw 100 firm headquartered in the South to have a female co-managing partner;
  • represented Martin Luther King, Sr. when the IRS unfairly targeted his church in the 1960s; and
  • provided pro bono counsel to Atlanta’s first black mayor Maynard Jackson’s mayoral re-election campaign in 1989.

For us, diversity in our workplace is about action and continually seeking better ways to empower and energize our diverse personnel for success. Their individual successes enhance both our ability to provide world-class services to clients and our collective and individual contributions to the strength and vitality of the communities in which we work and live.

Our Vision and Values

Commitment is the foundation of a successful effort to build and maintain a diverse and inclusive environment. We are working to attract the widest possible pool of top talent; provide opportunities for all attorneys and staff to maximize their potential and fully contribute to accomplishing our firm’s mission, and ensure that everyone is treated with dignity and respect.

Promoting diversity and its social imperative for fair treatment in our workplace without regard to racial, ethnic, religious, gender, sexual orientation and other self-defining factors is a core value of the firm -- a part of the fabric for our institutional life. We recognize both the social responsibility and the business opportunity of promoting diversity. It is the right thing to do, and it is good for business.
