Practice/Industry Group Overview

The Commercial Litigation Practice Group represents clients in all aspects of litigation including trials and appeals in all state and federal courts; federal, state and self-regulatory administrative proceedings; and arbitrations and mediations under alternative dispute resolution procedures. We stress a team approach to address and resolve each client’s litigation problems by drawing on the knowledge of the attorneys best qualified to handle a client’s unique problems.

Complex Litigation

Our attorneys routinely represent clients in factually and legally complex claims, including class actions.

Securities

We handle securities litigation for issuers of securities and their officers and directors, as well as national and regional brokerage and municipal finance firms.

Commercial Disputes

We have extensive experience in a variety of corporate and individual commercial litigation matters, including claims pertaining to contracts; banking; joint venture and distributor relationships; consumer protection laws; telecommunication and computer-related disputes; and matters arising under the Uniform Commercial Code.

Banking, Creditor-Debtor and Bankruptcy

A group of attorneys practice in lender/borrower, creditor/debtor relationships, which includes representing institutional lenders, loan workouts, debt restructurings, foreclosures, lender liability lawsuits and other bankruptcy-related matters.

Antitrust

We represent clients in antitrust-related litigation and advise clients regarding antitrust implications of transactions.

Health Care

Our attorneys represent health care institutions in matters pertaining to governance, antitrust and restraint of trade, regulatory matters and mergers and acquisitions.

Intellectual Property and Internet

Attorneys within this Practice Group have considerable experience in handling intellectual property and trade secret matters including federal and state trademark, copyright and patent matters.

Appellate

After a hard-fought trial, it is vital that representation at the next level of litigation be provided by experienced appellate lawyers who understand appellate litigation and all of its facets. The experience of the Firm’s appellate attorneys is reflected by their involvement in significant cases that have shaped the development of law in state and federal courts.

Insurance Coverage

Our attorneys routinely handle some of the most difficult and complex cases in federal and state courts throughout the country, including Washington and Alaska, two of the most challenging jurisdictions in the United States for insurers. We have handled a wide variety of coverage matters involving virtually every type of first-party and third-party insurance policy. Lane Powell lawyers have substantial experience in nearly all aspects of insurance coverage disputes from initial claims advice through trial and appeals.

Premises Liability

Lane Powell regularly defends premises owners in claims involving slip and falls, display fixtures, false arrest, liquor liability, food poisoning, and criminal acts of third parties. We frequently represent nursing homes, retailers and landlords, and are familiar with the unique legal issues concerning claims against them.

Product Liability

Our attorneys provide a broad range of support to manufacturers. The firm has provided representation for a wide variety of product claims involving electrical and gas powered consumer products, including large fire loss claims, and claims involving mobile and industrial equipment, airplanes, computer failure, elevators, man lifts, breast implants and other medical devices.

Real Estate and Environmental

The Firm handles all types of real estate disputes, including property tax valuations, land use, lease and boundary disputes, foreclosures, enforcement of restrictive covenants, enforcement of purchase agreements, hazardous material clean up liability problems, water rights, eminent domain, condemnation and the application, interpretation and constitutionality of land use and environmental laws.

Architects, Engineers and Construction

We provide a full range of legal services to meet the specialized needs of design professionals. Our attorneys, some of whom have engineering degrees, regularly defend architects and engineers of all disciplines in professional errors and omissions cases. We assist clients in all phases of the design and construction process, including the preparation of contracts for private and public projects, advice on lien rights, change orders and construction claims, and representation in litigation, arbitration and other dispute resolution forums.
