Bankruptcy Litigation
Litigation can be a necessary part of the bankruptcy process, and our lawyers are accomplished at representing clients in all the points of contention that come before the bankruptcy courts. That includes representation of creditors, creditors’ committees and trustees in fraudulent conveyance and preference litigation involving leveraged buyouts, Ponzi schemes, corporate stripping and asset protection. We will also handle your interests in both federal and state courts, for actions involving breach of contract, receivership, landlord-tenant, commercial loans, lien enforcement, equipment leasing, replevin, judicial foreclosure, guaranty and collection of domestic and foreign judgments.
Once a case is before the bankruptcy court, our focus is on whether a reorganization or liquidation of the debtor is the action best suited to recover the creditor’s investment. Creditors with interests at risk in bankruptcy depend on our help with all issues governed by the Uniform Commercial Code, such as sales, secured transactions, bank deposits and commercial paper. Our lawyers also help these clients with their collection needs, including obtaining pre-judgment and post-judgment remedies.
Labor and Employment
Lewis and Roca’s labor and employment lawyers represent employers in employment litigation, representation proceedings, collective bargaining, administrative proceedings, and counsel across the full range of the human resources spectrum. The group’s strengths for effective client service are the lawyer’s backgrounds, substantive labor and employment knowledge and diligent responsiveness.
We represent employers in state and federal courts against wrongful termination suits and individual or class/collective actions under the civil rights laws, the ADEA, ERISA, FMLA, other employment statutes, and regarding all aspects of restrictive covenants. We routinely represent employers before various regulatory agencies in discrimination, unfair labor practice, wage and hour, job safety and health matters and have provided counsel and training to management concerning problem-solving, legal compliance, union avoidance and, increasingly, alternative dispute resolution. For employers with bargaining units, we also provide advice and representation in collective bargaining, arbitration and other labor-management matters. Whether the case implicates political issues, sensitive psychological issues, or even criminal claims, the employment team is equipped to assist the client with creative strategies to reach the most effective outcome possible.
