The firm's Continuing Care Service Practice Group represents continuing care providers, including but not limited to, not-for-profit, for-profit and county-owned and operated skilled- nursing facilities, assisted-living facilities, adult day care programs, and governmental agencies that review and provide Medicaid coverage to individuals. The attorneys in this practice group are knowledgeable and experienced practitioners in the areas of litigation, trusts and estates and Medicaid compliance and recovery.
We understand that our clients, as heavily regulated continuing care providers and service agencies, require specific and timely advice in order to maximize their accounts receivable. Clients are provided consultation services and in-house training services in order to implement best-practices in the areas of admission, in-take, collection and recovery. Our attorneys review and revise our clients' admission packets to ensure their compliance with the requisite federal and state regulations; we maximize their available remedies in the event of the residents' monetary defaults and minimize adverse claims that may be asserted by the residents and their families.
We advocate for our clients in State Supreme Court, Surrogate's Court and before administrative agencies. Clients' "Medicaid pending" cases are reviewed to determine the likelihood of the residents' obtaining Medicaid chronic-care coverage and possible penalties. Our attorneys also assist clients with their appeals of Department of Health decisions.
Our attorneys strive to maximize the realization of our clients' accounts receivable and help them be proactive in the "Medicaid pending" process; this includes instituting precautionary measures so clients are favorably positioned when competing with the residents' other creditors in recovery proceedings.
