Contract Design and Negotiation
We assist general contractors, owners, construction managers, architects and engineers in drafting and negotiating construction contracts, and have extensive experience in all types of contractual relationships, including design/build, fast-track, construction management and more conventional owner/contractor and owner/architect relationships. Our construction attorneys are familiar with the standard construction and design contract documentation commonly accepted in the industry, including AIA and ConsensusDOCS forms, and, when necessary, draft customized agreements for particular situations. We also regularly provide advice to clients concerning public bidding and procurement issues.
Litigation, Arbitration and ADR
Litigation, arbitration and alternative dispute resolution (ADR) form a significant part of our practice. Our expertise includes bid protests, change order disputes, claims on performance and payment bonds, and contract terminations. Our attorneys represent clients before the federal and state courts, arbitration panels, mediators, and administrative and regulatory agencies concerned with construction-related ADR matters.
We have engaged in major corporate and financial transactions on behalf of private and public companies involved in the construction industry, from national developers and institutional investors to equipment and product manufacturers. These transactions include mergers, acquisitions and other corporate reorganizations, and public and private financings. The firm has done substantial work with state agencies in the financing of major transportation projects funded through bond issuances.
