Paul Rafferty is a business trial lawyer with 30 years of complex trial experience representing clients in defense of class actions, breach of fiduciary duty, trade secrets, contracts, and 17200 and 17500 claims. His degrees in accounting and sociology both assist him in effective representation of business clients, where he often collaborates on how best to resolve difficult legal issues within business transactions before they ripen into litigation.
As lead counsel, Paul has tried to conclusion civil matters to bench and jury. His last trial, a four-month breach of fiduciary lawsuit, resulted in a complete defense judgment and a $2 million attorney fees award. Paul primarily defends notable clients from class action lawsuits, all of which have ended favorably by summary judgment, successful defense of class certification, or on appeal. He is often asked to defend his lower court victories on appeal, two of which were recently affirmed and two were favorably settled. Most recently, he was engaged to defend a class action against a prominent university pertaining to football concussions, derived from multidistrict litigation involving the NCAA.
Paul's trial experience includes arbitration of significant matters. In France and New York, he successfully concluded multiweek arbitrations that enforced a client's worldwide rights to DNA technology. Paul also represents clients to fix undesirable arbitration awards. Most recently, he vacated a multimillion dollar award after proving an arbitrator had clearly exceeded his authority.
Paul has devoted substantial time to his community coaching Little League, AYSO soccer, softball, and football teams. Most recently, he authored and published his first book The Trophy Hunted.
