Paul Rafferty is a business trial lawyer with 30 years of extensive trial and appellate experience. He represents companies in complex civil litigation, including breach of fiduciary duty, trade secrets, contracts, 17200 claims, consumer claims, and particularly, class actions.
As lead counsel, Paul has tried to conclusion civil matters to bench and jury. His last trial, a four month breach of fiduciary lawsuit, resulted in a complete defense judgment for the client and a $2 million attorney fees award. He also successfully defends notable clients from class action lawsuits, all of which have ended favorably by summary judgment, successful defense of class certification, or on appeal. Regarding the latter, Paul is often asked to defend lower court victories on appeal, two of which were recently affirmed and two were favorably settled.
Paul's trial experience includes arbitration of significant matters. In France, he successfully concluded a multi-week arbitration which enforced the clients' worldwide rights to DNA technology. Paul also represents clients who engage him to fix undesirable arbitration awards. Most recently, he reopened discovery after arbitration had concluded, and then used the findings to vacate an interim award. Paul also had a multi-million dollar award vacated after proving an arbitrator had clearly exceeded his authority.
Paul's tenure as a lawyer is complimented by undergraduate degrees in accounting and sociology, both of which assist him in effective representation of business clients. Relying on this foundation, he often collaborates with clients on how best to handle difficult legal issues that arise within business transactions before they ripen into litigation.
