Served as counsel for the Official Committee of Unsecured Creditors in 13 jointly-administered chapter 11 cases involving primarily skilled nursing facilities and assisted living centers. · In re: Griffin Acceptance Corporation, United States Bankruptcy Court for Southern District of Mississippi, Case No. 09-01513-ee. Represented secured creditor in connection with the enforcement of its security interest in the inventory and accounts of an enterprise with eight stores in Mississippi and Arkansas that had filed a chapter 11 bankruptcy case. Client purchased the business of the Debtor as a going concern for a credit bid of a significant portion of its debt plus a cash payment which covered certain expenses incurred by the bankruptcy estate. · In re: Warehouse 86, LLC, United States Bankruptcy Court for Southern District of Mississippi, Case No. 08-03423-ee. Represented the Debtor, a commercial internet auction company, in its chapter 11 case. Through the chapter 11 case, we sold the business in a section 363 sale as a going concern to maximize the return for the unsecured creditors. Within the chapter 11 bankruptcy case, there is a dispute with an additional named insured over the rights to approximately $2 million in insurance proceeds. The case is still pending. · In re: Realty Mortgage Corporation, United States Bankruptcy Court for Southern District of Mississippi, Case No. 09-00544-NPO. Served as Mississippi counsel to secured lender with a claim in excess of $41 million in the chapter 11 case of a mortgage origination company. · In re: H&S Fish Farm, Inc., n/k/a Namid Farms, United States Bankruptcy Court for Southern District of Mississippi, Case No. 09-13451-NPO. Represented a bank as a judgment lien creditor of the Debtor in enforcing its rights under its judgment lien in this chapter 11 case. · In re: Barnhill s Buffet, Inc., United States Bankruptcy Court for Middle District of Tennessee, Case No. 3:07-bk-08948. Represented agent for former shareholders which sold business to Debtor in a reverse triangular merger to collect the balance of an escrow account that was established as a part of the merger transaction. · In re: Earl E. Gaylor and Edison Hotels and Resorts Company d/b/a Edison Walthall Hotel, United States Bankruptcy Court for Southern District of Mississippi, Case Nos. 07-02743-NPO and 07-02737-NPO. Appointed as the Examiner to investigate and report to the Bankruptcy Court on certain specified topics in these two affiliated chapter 11 cases involving the purchase by an insider of substantially all of the assets of the Edison Walthall Hotel. · In re: James C. Green, Jr., United States Bankruptcy Court for Northern District of Mississippi, Case No. 07-11869-DWH. Represented a bank as an unsecured creditor in this chapter 11 case and obtained a non-dischargeable judgment against the debtor on the grounds that the Debtor obtained those loans by false financial statements. · In re: Premier Entertainment Biloxi, LLC, d/b/a Biloxi Hard Rock Casino and Resort, United States Bankruptcy Court for Southern District of Mississippi, Case No. 06-50975 ERG. Served as Mississippi counsel for the controlling equity owner of the Debtor. Debtor filed a chapter 11 case to obtain turnover of insurance proceeds held by bondholders in order for the Debtor to rebuild a casino destroyed by Hurricane Katrina. The Debtor confirmed a chapter 11 plan that paid all creditors 100% of the principal amount of their allowed claims, together with interest on their claims. The bondholders appealed the confirmation order, but the Fifth Circuit held that the chapter 11 plan had been substantially consummated and dismissed the appeal. · In re: Biodiesel of Mississippi, Inc., United States Bankruptcy Court for Northern District of Mississippi, Case No. 06-10402-DWH. Represent the Debtor, an owner and operator of a biodiesel refinery, in its chapter 11 reorganization case. Sold the refinery through a section 363 sales process and paid all priority and secured claims. · In re: Winn-Dixie Stores, Inc. et al., United States Bankruptcy Court for Middle District of Florida, Case No. 05-03817-3F1. Represented the landlord of two of Debtor's stores in the chapter 11 case of this 800-store grocery company. Asserted claims for lease rejection damages and unpaid taxes and other expenses in excess of $1.1 million for our client and obtained favorable settlement of those claims.
