Biography

Andrew Kienle is a Shareholder and Managing Partner at Hart Kienle Pentecost. He manages the Civil Litigation and Transactional departments of the firm. In his practice, Andrew specializes in representing trustees, beneficiaries, and conservators in Trust and Estate disputes, as well as clients involved in complex business, real estate, and employment matters in State and Federal Court. He represents clients in all aspects of litigation, arbitration, mediation, and administrative hearings. Andrew has also successfully represented restaurant and commercial real estate industry clients in numerous litigation matters. His article has been published in various trade publications targeted to business owners, entrepreneurs, and restauranteurs in the Southern California region, and he is a repeat speaker at the annual Western Food Service & Hospitality Expo. Prior to his association with the firm, Andrew represented nationwide financial institutions in lender/borrower disputes and real estate developers in large-scale construction disputes.

Results:

- Obtained multi-million dollar judgment for client and her mother after bench trial in trust litigation matter, which included an award of double damages

- Obtained defense judgment for client after bench trial in a trust litigation matter, ensuring client's right to inherit an additional $1,000,000 in assets contained in father's trust

- Obtained defense judgment for clients after bench trial and appeal in real estate disclosure litigation matter, including the recovery of legal fees and costs

- Obtained defense judgement for client after bench trial in a trust litigation matter, including the recovery of legal fees and costs as well as confirmation of the enforceability of a prior settlement agreement

- Obtained judgments of dismissal in favor of trustee clients, who were sued for alleged trust administration issues

- Obtained judgement after bench trial and appeal in favor of client in real estate transaction dispute resulting in conveyance to client of real property worth significantly more than purchase price

- Obtained $650,000 Superior Court judgment for private Christian school in action against general contractor on school construction project

- Obtained summary judgment for client in trust litigation matter, securing client's right to an inheritance of more than $1,500,000

- Settled a real estate transaction dispute resulting in conveyance to clients of real property worth 175% more than purchase price
