Biography

Andrew Stewart is an associate at Carr Maloney P.C. He focuses his practice on professional liability, complex litigation, sexual abuse and misconduct, and employment and labor law.

Prior to joining the firm, Andrew was a judicial law clerk to the Honorable Cheryl A. McCally, Associate Judge for the Circuit Court of Montgomery County, Maryland. Over the course of his clerkship, Andrew prepared and wrote bench memoranda for criminal motions and sentencing hearings. He also researched and drafted opinions for complex civil motions, petitions for criminal post-conviction relief and coram nobis, administrative appeals from the district court, and in banc panel reviews.

After completing his judicial clerkship, Andrew served as an Assistant State’s Attorney for Montgomery County, Maryland for four years. While working at the State’s Attorney’s Office, Andrew prosecuted over one hundred bench trials across a variety of criminal and incarcerable traffic offenses (including misdemeanor assaults, burglaries, credit card and financial fraud, drug possession, DUIs, indecent exposure, felony thefts, motor vehicle thefts, and weapons offenses). While on the district court team, Andrew dedicated a substantial amount of his time to Driving While Impaired by Controlled Dangerous Substance cases, including preparation for a Daubert­ motion to suppress the testimony of a police officer who was qualified as a “Drug Recognition Expert” in response to the Rochkind v. Stevenson Court of Appeals decision in 2020. Andrew also handled several district court appeals and circuit court matters, gaining jury trial experience.

Andrew earned his law degree from Syracuse University College of Law, where he graduated magna cum laude. During law school, Andrew was on Syracuse Law Review, serving as an Associate Note Editor. Andrew was a member of the Justinian Honor Society, and received CALI Awards in Evidence, Civil Procedure, Trial Practice, and Legal Writing. Andrew also interned for the Honorable Glenn T. Suddaby, Chief Judge of the United States District Court for the Northern District of New York.

Andrew graduated from the University of Maryland, College Park with undergraduate degrees in Criminology & Criminal Justice and Psychology.
