Biography

Beth Bones is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization. She represents employers in workplace disputes and in matters before state and federal agencies. Beth works with businesses across industries, including health care, agriculture, and retail.

Beth handles claims involving harassment, discrimination, wrongful termination, retaliation, wage-and-hour issues under the Fair Labor Standards Act, Family and Medical Leave Act disputes, and restrictive covenant matters such as noncompete and non-solicitation agreements. She appears in state and federal courts throughout Texas, as well as the U.S. Courts of Appeals for the Fifth and Eighth Circuits. and handles charges before administrative agencies.

Beyond litigation, Beth counsels employers on day-to-day compliance. She reviews handbooks and policies, conducts training, provides updates on new regulations, and advises on human resources matters. Her guidance covers federal and state laws, including Title VII, the Americans with Disabilities Act, the Family and Medical Leave Act, the Age Discrimination in Employment Act, the Fair Labor Standards Act, and state anti-discrimination laws.

Experience

Representative Matters

• Represented school music dealer in defense of lawsuit by competitor alleging breach of employment agreements, specifically noncompete, non-solicitation provisions, tortious interference of contractual relationships, misappropriation of trade secrets, and seeking injunctive relief in connection with the hiring of three former employees of competitor. (Texas State Court).°

• Represented a nonprofit residential care organization for at-risk children in defense of claims brought by former house parents for religious discrimination and retaliation under Title VII and Texas state law, defamation, and failure to pay overtime in violation of the FLSA. (Northern District of Texas-Amarillo Division).°

• Represented employer defending against wage/hour overtime claim brought by former employee. Conducted written discovery and depositions. Defeated plaintiff’s claims on summary judgment arguing employee was exempt under the Fair Labor Standard Act’s agricultural exemption. Employee appealed to the Eighth Circuit. Eighth Circuit affirmed district court’s ruling upholding summary judgment for client. (Northern District of Iowa).°

• Represented employer defending against claims by former employee alleging interference and retaliation in violation of the Family Medical Leave Act brought in state court and removed to federal court. Obtained settlement terms following summary judgment briefing and hearing. (Southern District of Iowa).°

• Represented physical therapy organization and owner/operator of long-term care facilities in a variety of employment-related issues, including defending sexual harassment lawsuit by assistant director of nursing against employer and CEO, defending race and gender-based discrimination claims at agency level, and responding to wage/hour and leave issues raised by employees.°

• Represented nurse practitioners in wage/hour claim against former employer (clinic and physician) for unpaid overtime and off-the-clock hours worked away from clinic. Case resulted in settlement just prior to the pre-trial conference. (Northern District of Texas-Amarillo Division)°

• Provision of advice to employers in a variety of matters involving federal and state laws including the Fair Labor Standards Act, Title VII, the Americans with Disabilities Act, Family Medical Leave Act, Age Discrimination in Employment Act, and applicable state anti-discrimination law.°
