FAMILY LAW IS ABOUT MORE THAN DIVORCE

Of course, the field of family law in California is about much more than merely divorce. At Bayati Law Group, we also help couples who need a pre-nuptial or post-nuptial agreement, and grandparents who are seeking visitation rights or child custody. We handle paternity claims, and we help the victims of domestic violence obtain the court orders and legal protection that they need. We also handle legal alternatives to divorce such as annulments and legal separations.

Many couples in California seek legal separation rather than divorce, sometimes for religious reasons as an alternative to divorce, or sometimes to take the time to resolve their issues and work toward a marital reconciliation. Although a legal separation is not a divorce, there will still be a number of issues to resolve, and you may need to retain an attorney and obtain a formal legal separation agreement. Annulment can be similar to a divorce, except that you wish to “annul” a marriage – that is, to declare that it was never a valid marriage – rather than “dissolve” a marriage that was in fact valid. Not every state offers the annulment option, however, and even California courts will not grant every annulment request.

ALTERNATIVES TO THE COURTROOM

Bayati Law Group also offers out-of-court divorce options – such as arbitration and mediation – for those divorcing couples who are able and willing to work together to resolve their divorce-related disputes. Divorcing spouses who wish to avoid expensive litigation often opt instead for an arbitration proceeding. An arbitrator can usually resolve a divorce and the related issues in far less time – and more cost-effectively – than a judge. If both spouses can agree in advance to accept arbitration, an arbitrator’s decisions will be final.

Mediation is similar to arbitration in some ways; the goal in divorce mediation is to resolve the key issues in a divorce without the need for a courtroom trial. Mediation is an entirely non-adversarial process; both parties work through their issues with a neutral mediator. Not only is mediation a cost-effective way to resolve a divorce, but it provides the opportunity to reach a fair resolution to all of the issues that are important to both divorcing spouses.

Conventional, courtroom-centered divorces still happen every day in the state of California, and when a number of issues are in dispute, a conventional divorce remains the right option. In 2019, 2020 and 2021, the American Institute of Family Law Attorneys recognized Orange County attorney Brian Bayati as a “10 Best” family law attorney in the State of California for “Exceptional and Outstanding Client Service”.

Brian graduated from the University of California, Hastings College of the Law, in San Francisco. While attending law school, Brian was a judicial extern to the U.S. Court of Appeals (Ninth Circuit), and he was also active as a public service mediator. Prior to founding the Bayati Law Group in Orange County, Brian was legal counsel for a national corporation and part of a prestigious Los Angeles-based civil litigation firm with offices throughout California and across the United States.

Brian Bayati is also an active member of the Orange County Bar Association and an active member of the Orange County Bar Foundation and its Society of Fellows. Brian is a member of Orange County Bar Association Lawyer Referral and Information Services Committee, an arbitrator for the Orange County Bar Association Mandatory Fee Arbitration Committee, and a member of the State Bar of California Family Law Executive Committee.
