Biography

Brian Jones is a partner at Bose McKinney & Evans and is the Chair of the firm's Data Privacy group and co-chair of the firm's Insurance Group. He is a fellow of Litigation Counsel of America, a Certified Information Privacy Professional for the United States, and has been listed in The Best Lawyers in America since 2016. Brian represents clients in all aspects of sophisticated and complex litigation, but focus on the areas of insurance, data privacy regulation and breaches, consumer protection, antitrust, contracts, and class actions. Brian's practice includes helping clients facing False Claims Act allegations from both the government and qui tam whistleblowers.

His experience includes:

Representing a domestic automobile insurer in a multi-district litigation alleging violations of the Sherman Act associated with direct repair programs;
Assisting health-care clients with GDPR compliance;
Helping financial services clients navigate data breach responses;
Representing a domestic insurer at trial and appeal concerning allegations that it paid the incorrect beneficiary of a life insurance policy;
Representing financial services clients in numerous cases concerning violations of the Telephone Consumer Protection Act;
Representing a religious association in litigation concerning a health insurance enrollment contract;
Representing a domestic TV importer at trial and appeal concerning the alleged breach of contract of a commercial warehousing agreement;
Representing a U.S. bank in a class action alleging violations of the Electronic Fund Transfer Act;
Representing a domestic insurance association, as amicus curiae, supporting the transfer of a class action to the Indiana Supreme Court;
Representing a CEO at trial and appeal in a case brought by his former employer alleging financial misdealing;
Representing a U.S. hotel chain in a case alleging violations of a commercial lease;
Representing a domestic insurer regarding coverage for claims arising from contaminated produce;
Representing a Bermuda reinsurer in an ARIAS arbitration concerning a 'finite' stop-loss agreement;
Representing a Bermuda reinsurer in a series of cases in South Texas concerning a workers compensation coverage scheme;
Representing a domestic life insurer in an ARIAS arbitration concerning a number of denied 'impaired risk' life insurance policies;
Representing a domestic insurer in an ARIAS arbitration concerning automatic premium adjustments;
Representing a London excess insurer concerning coverage for disallowed tax shelters sold by a national law firm;
Representing a domestic insurer and reinsurer in an ARIAS arbitration and related state court insurer receivership proceeding concerning the validity of certain policy transfers under U.K. law.

Brian received his bachelor's degree, cum laude, in political science and his master's degree in teaching from Trinity University, where he was elected to Phi Beta Kappa. He received his doctorate in jurisprudence from the University of Texas School of Law, where he was the director of communications for the Legal Research Board and a member of the Phi Delta Phi Honor Society. Prior to attending law school, Brian taught high school social studies in San Antonio, Texas. Brian is a member of the State Bars of Indiana and Texas, a member of the International Association of Privacy Professionals, a former member of the Pro Bono College of the State Bar of Texas, and is licensed to practice before all state and federal courts in Indiana and Texas, as well as the Northern District of Illinois, and the United States Courts of Appeals for the Fifth, Sixth, Seventh, and Eleventh Circuits.
