Biography

Mr. Radler, a partner with Dughi, Hewit & Domalewski who joined the firm in 1983, directs the firm’s business-law department.

He provides litigation, arbitration, mediation, and counseling services to clients facing corporate and commercial disputes and those navigating issues related to business practices, and restrictive covenants and probate matters. In the Chancery Division of the Superior Court, Mr. Radler has successfully prosecuted and defended dozens of orders to show cause involving restraining orders, injunctions, and the appointment of receivers and special fiscal agents, and fraudulent transfers. He has obtained numerous constructive trusts freezing the assets of defendants, and he has successfully recovered millions of dollars of those assets, including real estate in the United States and elsewhere, securities, bank accounts and life insurance proceeds from the perpetrator of a Ponzi scheme. Mr. Radler also maintains an active construction-law practice, where he represents both builders and owners in cases involving construction defects and consumer fraud.

Mr. Radler has formulated hundreds of estate plans and has drawn the Wills, Living Wills and Powers of Attorney to implement them. He represents fiduciaries in the administration of trusts and estates, and he defends their interests in probate litigation. He also challenges Wills based on undue influence, lack of competence, or improper execution. He has successfully litigated probate cases involving non-probate assets, including joint accounts, pay-on-death (POD) accounts, transfer-on-death (TOD) securities, annuities and tax-deferred retirement accounts, including 401(k) plans and IRAs.

With extensive experience in a wide range of corporate and commercial transactional matters, Mr. Radler handles secured-loan transactions, loan and lease workouts outside of bankruptcy, commercial financing, and equipment and real-estate leases. He regularly represents companies, shareholders, and partners in the purchase and sale of businesses, professional practices and automobile dealerships, as well as in negotiating and litigating business separations.
