Biography

Mr. McNally co-supervises the team of attorneys handling long-term care/nursing home malpractice cases at the firm. Mr. McNally also supervises the general representation of numerous skilled nursing provider clients including skilled nursing homes, continuing-care retirement communities, assisted living providers and ancillary LTC businesses in a wide-array of commercial and business matters including the handling of involuntary discharge litigation, Medicaid consultation and litigation, guardianships, estate litigation and large-dollar collections. Mr. McNally also handles a wide variety of commercial litigation matters including breach of contract matters, Medicaid fraud investigation/defense. Mr. McNally is widely recognized as an expert in the area of Medicaid eligibility and compliance and lectures frequently on the topic of Medicaid eligibility for providers and business offices. Mr. McNally also has experience in high-dollar complex toxic tort litigation and brings skilled litigation experience to his entire practice.

Mr. McNally also handles numerous other areas of practice including insurance defense/personal injury defense matters on behalf of institutional and business clients including supermarkets, trampoline parks, casinos, property management companies, assisted living providers and other businesses. Mr. McNally also handles commercial contract disputes, guardianships, and elder-law consultation for both families and providers.

Mr. McNally has been an attorney with the Bodie firm since 2006, having spent his career working on large and complex cases with a concentration in the defense and representation of long-term care (LTC) institutions, nurses and caregivers in complex malpractice litigation and insurance defense litigation in complex toxic tort/lead paint cases. Mr. McNally is an AV-Preeminent®-Rated attorney by Martindale Hubbell and has been a recognized SuperLawyer® from 2014 – Present.

Mr. McNally is also a frequent lecturer on topics germane to the defense of LTC providers, Medicaid eligibility and revenue management. Mr. McNally has conducted numerous mock trials, seminars, mock depositions, and has co-presented with judges, prominent attorneys and nursing/LTC professionals. In addition to many previous lectures and presentations, Mr. McNally is a regular lecturer at the Lifespan Conference and the Beacon Institute. Mr. McNally is an enthusiastic supporter of senior providers in general including Lifespan, HFAM and his own clients having been a presenter, sponsor and lecturer at numerous conferences, seminars and in-house CE presentations for over over 17 years. Mr. McNally also regularly sponsors special events for senior living providers including the annual Lifespan Conference (VIP sponsor for guest celebrities including Cal Ripken and Ed Reed), Exhibitor at the annual Lifespan Conference, Lifespan Golf Tournament (sponsor and very poorly golf-playing participant!), the Homewood Golf Tournament and the Annual Brooke Grove Jet Ski event.

Mr. McNally is a proud graduate of Loyola Blakefield High School in Towson. Mr. McNally is also a graduate of Franklin & Marshall College (B.A. 1996) and the University of Baltimore School of Law (J.D., 1999). Mr. McNally was admitted to the Maryland State Bar in 1999 and the United States District Court for the District of Maryland in 2000.

Following graduation, Mr. McNally clerked for the Honorable John Carroll Byrnes in the Circuit Court for Baltimore City and spent four years working in the defense of legal and medical/nursing professionals in malpractice litigation at Eccleston and Wolf prior to joining the Bodie Firm. Mr. McNally is a member of HFAM, The Beacon Institute, Baltimore County Bar Association, Maryland State Bar Association, the Women’s Bar Association and the Defense Research Institute (DRI).

Mr. McNally is married with two children and is an avid lifelong history, railroad and transit enthusiast. Mr. McNally is the Executive Vice President of the Baltimore Streetcar Museum where he also works as a volunteer motorman/conductor and serves as legal counsel to the museum. Mr. McNally also is an active alumnus with the Franklin and Marshall Alumni Association having served on the Alumni Board from 2003-2010. Mr. McNally also serves on the Board of Trinity School in Ellicott City, the Board of Charlestown in Catonsville and the Lifespan LPS Board.
