Biography

Daniel Bennett is a shareholder focusing his practice on product liability, premises liability, automobile liability, trucking and transportation, and insurance coverage and bad faith matters. With more than thirty-five years of experience, he represents clients in high-exposure litigation, including wrongful death, catastrophic injury, and uninsured/underinsured motorist claims.

A highly experienced trial attorney, Dan has tried cases in all Delaware courts across all three counties and has argued numerous matters before the Delaware Supreme Court. Over the course of his career, he has investigated, litigated, or assisted in the resolution of more than 25 wrongful death cases, along with many others involving catastrophic injuries.

Dan is known for his hands-on, client-focused approach, maintaining direct and consistent communication with clients and adjusters throughout the life of a case. He prioritizes timely, strategic reporting and works to identify impediments to resolution early, implementing cost-effective strategies that serve both clients and carriers. His skill and professionalism have earned him an AV Preeminent rating from Martindale-Hubbell, recognizing excellence in both legal ability and ethical standards.

His representative experience includes securing multiple defense verdicts and favorable appellate outcomes in high stakes matters, including cases involving catastrophic injuries, complex liability issues, and significant claimed damages. He has also successfully argued issues before the Delaware Supreme Court, including matters involving expert testimony requirements and summary judgment standards.

In addition to his litigation practice, Dan is a frequent seminar presenter for both the firm and the National Business Institute, speaking on a wide range of personal injury and insurance-related topics, including premises liability, ethics, uninsured/underinsured motorist coverage, and the interaction between personal injury protection (PIP) and workers’ compensation benefits. He also serves as a mediator and arbitrator in personal injury cases.

Nearly a lifelong Delaware resident, Dan is married and the father of three daughters. Active in his church, he has served as Presiding Judge for the Ecclesiastical Trial Court for the Episcopal Diocese of Delaware. Outside of his practice, he enjoys cooking, collecting sports trading cards, fantasy sports leagues, and listening to Jimmy Buffett and the Zac Brown Band.
