Biography

Daniel R. Milstein is a litigator experienced in a broad array of complex commercial disputes. His practice primarily focuses on enforcing secured creditors' rights and disputes involving the owners, operators, sellers and buyers of commercial real estate. Mr. Milstein represents clients in litigations and alternative dispute resolutions in state and federal court.

Prior to joining Greenberg Traurig, Mr. Milstein spent three years as transactional, business and litigation counsel to a variety of health care industry clients, including hospitals and health systems, physician practices, and medical education programs.

Experience: Representative Matters: Represented purchaser in successful action to recover damages from seller for breach of representations and warranties in sale of $387 million portfolio of four commercial properties, including one of the largest buildings in New York City.; Defended private real estate investment fund and its principals in action seeking $50 million in damages for alleged tortious interference with contract, theft of trade secrets and breach of fiduciary duty.; Defended major commercial lender in action by loan applicant for $40 million in damages for alleged breach of contract to fund the applicant's planned acquisition of a New York City real estate portfolio.; Defended REIT that owned Times Square property in an action by the ground tenant to obtain non-disturbance agreements for subtenancies that would have devalued the property.; Obtained recoveries on behalf of foreclosing lenders in several actions arising from criminally fraudulent mortgage loan scheme in which many investors lost several million dollars.
