Biography

Dave Magaldi devotes his practice to representing Pennsylvania workers who have been injured at work.In 2002, Dave graduated from Temple Law School and was hired as a Judicial Law clerk for the Honorable Joyce S. Kean who handled municipal court criminal appeals.

At the conclusion of the clerkship, Dave realized that criminal law was not the direction that he wished to take his career. He then took a position with a small plaintiff’s personal injury firm handling auto accident and slip and fall cases for one year.

Dave then was hired by a large insurance defense firm as a junior associate to handle PA Workers’ Compensation Claims, and then worked as a workers’ compensation defense attorney for approximately 11 years at two different defense firms followed by a short stint with a small claimant’s workers compensation firm in Philadelphia. In 2015, Dave was hired as Risk Management Counsel for the City of Philadelphia where he worked for 2.5 years. As Risk Counsel, Dave was responsible for overseeing the Injured Workers’ Program at the City of Philadelphia including overseeing a 46 person Third Party Administration Staff, and coordinating the training and delivery of benefit with departmental safety officers.

Dave was also appointed as the City’s Heart and Lung Partial Arbitrator and as the City Solicitor’s designee on the Board of Pensions Benefits Committee. In July 2017, Dave left the City to take a position with a Regional Workers’ Compensation Third Party Administrator as their Director of Claims Operations.

As director of Claims, he was responsible for overseeing all Claims handling for a variety of self-insured entities in Pennsylvania and New Jersey including SEPTA, Cooper Hospital, several NJ Counties, Philadelphia Gas Works, Lackawanna County, the City of Easton, and others. Dave returned to representing injured workers in November 2018. He brings a unique perspective to any workers’ compensation case. He not only understands the concerns of the injured worker, but is able to draw on his experience and put himself in the shoes of both the employer and the insurance company.

Born and raised and still residing in South Philadelphia, Dave comes from blue collar roots. He knows what hard work looks like. He was born to teenage parents who struggled to make ends meet. Dave understands how the loss of an income can devastate a family. He applies this understanding to his practice. It is this understanding that drove him to become the first person in his family to earn both four year and advanced degrees, and what continues to drive him in helping clients overcome their adversity.When not at work, Dave is a dedicated father of two sons who remind him every day that they will soon be taller than him.

He is married to his first and only college girlfriend. They have been together since 1994, and, allegedly, she still generally likes him. When not with the family, you can find Dave playing Sunday morning baseball in local men’s leagues where his 17 hop singles look much better in the scorebook than in person.
