Biography

David J. Bishop joined Dughi, Hewit & Domalewski, P.C. in 2023.

Mr. Bishop handles a wide variety of matters related to civil litigation, with a primary focus on the defense of medical professionals. He has successfully litigated cases in both state and federal court on behalf of physicians, nurses, and hospitals. He is a frequent lecturer to medical professionals, advising on best practices to reduce their exposure to litigation.

A 1985 graduate of the College of the Holy Cross, Mr. Bishop earned an undergraduate degree in Mathematics. While completing his degree, he was awarded a United States Air Force scholarship. Mr. Bishop subsequently graduated from Rutgers University School of Law in 1992 and started his career with Horn, Goldberg, Gorny, Daniels, Paarz, Plackter and Weiss in Atlantic City, New Jersey. In addition to his legal work at Horn, Goldberg, Mr. Bishop was instrumental in designing and developing the firm’s litigation management software.

Mr. Bishop joined Paarz, Master & Koernig in 1994 and was ultimately named a partner at the firm. Paarz, Master was a general practice firm with a focus on litigation for medical malpractice and liquor liability defense.

In 2001, Mr. Bishop was a founding partner of Crammer & Bishop, a boutique law firm located in Absecon, New Jersey that was devoted to defending medical professionals and entities in malpractice, disciplinary, and licensing disputes. Seeing an opportunity to expand its service to clients, the firm of Crammer, Bishop & Crammer recently merged with Dughi, Hewit & Domaleski.

Mr. Bishop was admitted in 1992 to practice in New Jersey, Pennsylvania, and the U.S. District Court for the District of New Jersey. He was admitted in 2007 to also practice in the U.S. Circuit Court of Appeals for the 3rd Circuit.

Active in his community of Linwood, New Jersey, Mr. Bishop has volunteered as a coach in baseball, soccer, basketball and the Mainland Regional High School state champion Mock Trial Team. He is a past member of the Atlantic County Parks & Environment Advisory Commission, the Linwood Public School Advisory Council, the Linwood Recreational Board, and the Atlantic County First Tee board.

Examples of Success

• Represented a surgical oncologist is a state case alleging lack of informed consent and a failure to obtain appropriate surgical margins in a patient diagnosed with invasive papillary carcinoma. After a two-week trial the jury found that the patient had been properly informed of the risks and alternatives to the recommended course of treatment, and that the surgeon had properly performed surgery.

• Represented a hospital and multiple nurses in a federal case involving an adverse reaction to medication causing the patient to suffer respiratory distress that required emergency resuscitative measures. The patient claimed that she suffered an injury to her cervical spine and shoulder as a result of the code, and that she suffered permanent visual deficits. The hospital was dismissed on a motion at the beginning of trial and the nurses were found to have met the standard of care in their collective treatment.

• Represented a nurse in a surgical case involving a claim of improper positioning resulting in permanent injury. The case was complicated by a Court ruling that shifted the burden of proof to the defendants to exculpate themselves from the case. The represented nurse defendant was found to have proven her compliance with the standard of care and a verdict of no cause of action was entered.
