Biography

David is licensed in the state and federal courts of both Florida and Georgia, and has been admitted, pro hac vice, to other state and tribal courts. David is Florida Bar Board Certified in Construction Law, and has experience in jury and non-jury trials, arbitrations before privately-appointed panels and panels appointed under the American Arbitration Association rules, administrative law proceedings and tribal court. In addition, he has prosecuted and defended appeals at the District Court of Appeal and Circuit Court of Appeal levels.

Though he often handles business and contract disputes, and administrative licensing matters, David specializes in construction-related litigation, and drafting and negotiating construction contracts for every aspect of a project. David has represented contractors, subcontractors, suppliers, sureties, county and city governments and private owners. Examples of matters David has handled:

    • Prosecuted and defended competing business claims of more than $2 million through arbitration, trial and appellate levels.
    • Prosecuted contractor’s $2.5 million contract claim, and defended against owner’s $10.5 million counter-claim on multi-building luxury apartment complex project.
    • Prosecuted county government’s $3.5 million claim against engineering firm for defective design of underground utilities project.
    • Prosecuted two utility contractors’ claims, $1.13 and $1.25 million, respectively, against county government, and defended against county’s alleged $715,000 and $375,000 respective counterclaims.
    • Defended contractor through final hearing and appeal stages of bid protest on a $20 million federal construction project.
    • Prosecuted “themeing” contractor’s $600,000 claim against Indian tribe, and defended against Tribe’s counterclaim.
    • Represented and coordinated foreign representation of pre-fabricated construction contractor on multi-million dollar projects nationwide.
    • Represented, drafted and negotiated contracts for specialty design/build contractor for multi-million dollar projects nationwide and internationally.
