Elisabetta Giovando represents clients in civil and commercial litigation and arbitration, as well as bankruptcy and insolvency proceedings. Elisabetta deals with complex litigation matters before Italian courts and arbitration tribunals in cases involving director and auditor liability, breach of contract, bank guarantee, and application damages. She also deals with precautionary actions on behalf of Italian and foreign clients, and has represented companies active in IT, pharmaceuticals, insurance, energy, and construction.

Elisabetta advises both debtors and creditors at all stages of insolvency proceedings.

Representative Matters

• Assisted an energy society in a claim before the civil Court of Milan against the Italian company leader in the natural gas transport. The claim arose by the request to cancel in its balance sheet the value of the transactions of another energy company for which our client was guarantor for a while.°

• Assisted the client, an Italian company operating in the ICT sector in a complex litigation proceeding before the Court of Milan, regarding the supply and maintenance of a software. The dispute is now in the second instance.°

• Assisted a company operating in the ICT market, in various proceedings before the Court of Milan and of Draguignan (France) regarding the development and supply of software for the automotive market.°

• Represented a Real Estate Polish company in the proceeding before the Court of Florence against an Italian company, a general contractor for design and construction projects. The case concerns the award of a contract for the construction of a skyscraper in Varsavia, according to the project of the famous architect Libeskind.°

• Assisted a construction Italian society in a proceeding against the Municipality of Milan regarding the breach of a preliminary contract of real estate sale.°

• Assisted a Group, which is involved in the requalification and development of a former industrial area in Lombardia, in a dispute pending before the Arbitration Chamber of Milan against a construction company. The dispute concerned the effectiveness of a put option exercised by the other party.°

• Involved in several arbitrations end proceedings before the Court Of Appeal of Milan and the Catania Court regarding the request of compensation for damages promoted by some investors for the alleged malpractice of one of Corner Sim financial dealers.°

• Assisted a company, controlled by a government-appointed administrator in several proceedings with different counterparties regarding the rejection of total debt statement.°

• Represented an Italian health care company in a proceeding against an insurance brokerage agency, regarding compensation for damages for breach of contract (Court of Appeal of Milan).°
