Biography

Eric Hieber maintains a robust construction law practice, representing real estate developers, owners, and investors in all aspects of project development and construction across the country. He has deep experience drafting and negotiating construction and design contracts, advising clients early in the project life cycle on delivery methods and contracting structures (including both industry-standard forms and bespoke agreements). Eric has negotiated agreements worth billions of dollars across a wide range of project types, including office, residential, mixed-use, sports venues, industrial, student housing, and cultural institutions. Throughout construction, he partners with clients on contract administration, risk management, project closeout, and dispute resolution.

As a civil engineer by training, Eric brings real-world experience to his practice from his years working at one of California’s largest general contractors, where he managed project design development, estimating, procurement, contracting, and construction administration. In addition, he has deep experience representing developers in high-stakes construction and real estate litigation. This combination of legal and industry experience allows him to provide practical, solution-oriented counsel to his clients.

• Represented international technology company as construction counsel for its $250M corporate campus in the Bay Area, California.°

• Represented real estate developer as construction counsel on several student housing developments in the Bay Area, California, ranging from $80M to $120M.°

• Represented cultural institution as construction counsel for $90M development and improvements to its facility in San Francisco, California.°

• Represented real estate developer as construction counsel for various improvements at its properties across the country, including lobby and building improvements at its properties in New York City, Chicago, and Washington, D.C.°

• Represented cultural institution during construction of improvements to its museum in San Francisco, California, including alternative dispute resolution and litigation regarding defective work and delays, as well as drafting and negotiating construction and design contracts for extensive corrective work.°

• Represented owner in contract dispute regarding large casino development in Colorado, including developing initial case strategy, developing timeline of key documents and issues, and drafting pleadings.

• Represented owners of various high-value single-family residences in California and Nevada in negotiating design and construction agreements for renovations and new construction.°

• Represented construction robotics startup in the drafting and negotiation of equipment leases and other business agreements.
