Biography

Eric W. Swanis is an experienced trial lawyer with a diverse practice who counsels local, national and international companies in a wide array of matters including complex business, financial services, real estate, and mass tort issues in federal and state venues across the country. He represents publicly and privately held companies in cases involving breach of contract, unfair competition, fraud, misappropriation of trade secrets, breach of fiduciary duty, negligence, strict liability, and conspiracy claims. In addition, he has handled intellectual property, bankruptcy, construction, and a variety of creditor/debtor matters involving RICO, state consumer protection and unfair trade practices laws, Fair Credit Reporting Act (FCRA), Real Estate Settlement Procedures Act (RESPA), and Truth in Lending Act (TILA).

Experience: Representative Matters: In a Nevada case of first impression, obtained case-dispositive ruling on behalf of a national client that car rental companies are not required to independently verify the status of a renter's motor vehicle license beyond assessing its facial validity.; Acted as primary counsel in mass tort litigation involving thousands of plaintiffs alleging strict product liability claims against several of the world's largest pharmaceutical and medical device manufacturers.; Defended international and national pharmaceutical and medical device manufacturers and distributors against product liability and failure to warn claims brought by hundreds of plaintiffs.; Defended hedge fund sued by numerous investors against allegations of improper servicing of securitized assets.; Prosecuted patent infringement claims against numerous international automotive part manufacturers.; Defended numerous national lenders and loan servicers in high volume of borrower suits alleging wrongful foreclosure, unfair trade practices, unfair lending practices, breach of fiduciary duty and quiet title claims.; Defended one of Mexico's largest real estate developers against $35 million joint venture and unlawful circumvention claim relating to a Las Vegas resort and casino.; Represented Taiwanese company in fraud and breach of contract claim involving more than $230 million in damages claims over Las Vegas resort.; Defended Japanese mortgage investment bank affiliate against fraud and breach of contract claim involving damages exceeding $1 million.; Defeated claim for specific performance and lis pendens, on $62 million real estate contract, asserted against a Las Vegas hotel and casino.; Defended prominent computer manufacturer against breach of contract claim involving more than $40 million in claimed damages.; Prosecuted defective software claim and obtained proprietary source code on behalf of gaming company against software manufacturer.; Defended jewelry manufacturer against trademark infringement claims involving national advertising.; Prosecuted defective elevator claim against national elevator company and state university.; Prosecuted claim against former employee of national company for breach of employment contract and duty of confidentiality.; Defended Wall Street bank and international insurance company against bad faith claim involving death of insured.; Noteworthy Experiences: Licensed Broker/Salesman, 2005; Legislative Internship, U.S. House of Representatives
