Biography

Erin Eiselein represents hospital systems, medical groups, practitioners, and community health organizations on a variety of matters affecting the health care industry. Erin’s understanding of both the law and the shifting regulatory, political, and business issues impacting health care providers allows her to advise clients on a wide range of regulatory compliance, investigative and dispute resolution issues arising in this dynamic industry.

Erin’s extensive complex commercial litigation experience includes representing health care clients in cases involving contract and tort law, antitrust, consumer protection, False Claims Act (FCA) issues, misappropriation of trade secrets, managed care litigation, employment, and real estate disputes. Additionally, Erin has vast knowledge of patient privacy matters, including state data privacy laws and HIPAA. She has testified as an expert witness on these issues and authored a book on HIPAA compliance in the behavioral health setting.

Experience: Representative Matters: Represented a large American health care company in an arbitration related to the implementation of a telehealth program during the COVID-19 pandemic. The plaintiff physician claimed that the client wrongfully terminated his employment when he refused to see patients via telehealth because it interfered with his medical judgment.; Defended small nonprofit organization against a large company that was seeking to use the judicial system against the client. Obtained complete dismissal with prejudice within six weeks.; The above representations were handled by Ms. Eiselein prior to her joining Greenberg Traurig, LLP.
