Biography

Eva M. Spahn is a multilingual commercial litigator, trial lawyer, and problem solver representing U.S. and foreign clients in domestic and cross-border class actions, products liability, financial services, and other complex commercial disputes in state and federal jurisdictions and multiple arbitration forums. Ms. Spahn advises clients in all aspects of dispute resolution, from pre-litigation negotiations to trial and post-trial proceedings, and has represented major national financial institutions, manufacturers, and other clients in a variety of industries. Ms. Spahn is a proven litigator with first- and second-chair trial experience who works with clients to find successful solutions to legal disputes.

Experience: Representative Matters: Defeated a motion for class certification in Florida federal court and obtained dismissals in California, Georgia and Arizona on behalf of an air conditioning manufacturer in a series of nationwide putative class actions alleging product defects and asserting warranty breaches and violation of consumer protection laws, including FDUTPA.; Defending plumbing product manufacturer in nationwide class action alleging product defects and asserting claims for strict liability, design defect, failure to warn, breach of warranty, and violation of state consumer protection laws.; Defended national automobile manufacturer against warranty, fraud, and consumer protection claims related to alleged product defect.; Obtained final award in favor of Canadian software implementation company in multimillion-dollar international arbitration proceeding brought against it by former client for breach of contract and various fraud-based claims.; Obtained arbitration award for damages, fees, and costs on behalf of a Canadian technology company in international arbitration against a major competitor for tortious interference with contractual and business relationships. Obtained confirmation of arbitration award by the Southern District of Florida and an additional award for fees and costs in confirmation proceedings.; Obtained arbitration award in favor of Fortune 500 company on contractual claims asserted against former joint venture and commercial consultants in South America under U.S. and foreign law.; Obtained dismissal with prejudice of contract claims filed against an instrumentality of a foreign government based on sovereign immunity and other jurisdictional grounds, which was later affirmed by the Eleventh Circuit Court of Appeals.; Obtained summary judgment in favor of financial institution on fraudulent inducement claim asserted by borrower in connection with commercial real estate financing, which was later affirmed by the Florida Third District Court of Appeal.; Obtained dismissal with prejudice of contract claims asserted against national financial institution in connection with commercial real estate acquisition financing.; Participated in conducting internal risk assessment and developing anti-corruption compliance program for multinational retail company with operations throughout Latin America and elsewhere abroad.; Previous Experience: Judicial Intern, Honorable Edwin G.
