Biography

Evan Greenberg is a former associate at Nolan Barton Olmos & Luciano who is now of counsel with the firm, with an emphasis on motion and appellate matters. He graduated in 2010 from Santa Clara University School of Law, earning summa cum laude honors and entry in the Order of the Coif.

On numerous occasions, Evan’s written motions have resulted in courts excluding evidence against his clients or dismissing cases entirely.

Since law school, Evan’s practice has focused on criminal defense in state and federal cases, in both trial and appellate courts. He began his career representing defendants in cases involving parole, prisoners’ rights, criminal appeals, and post-conviction litigation. He also represented the plaintiffs in a successful class action lawsuit challenging California’s practice of holding inmates in solitary confinement indefinitely. He then worked for Coleman & Balogh LLP, specializing in federal criminal defense at the trial and appellate levels. Evan has argued before the California Court of Appeal and the Ninth Circuit Court of Appeals. Starting in 2017, Evan spent three years developing his trial skills as a Deputy Public Defender in San Francisco, Tulare, and Solano counties. He represented defendants in misdemeanor and felony cases and obtained acquittals at trial in cases of first-degree burglary, theft, indecent exposure, hit and run, driving under the influence, and driving without a license.

Evan is also one of the few trial attorneys who handles appeals and post-conviction cases, and he has argued dozens of times before state and federal appellate courts. His written motions in the trial courts have resulted in the exclusion of evidence against his clients or dismissal of charges on numerous occasions. And if things go wrong at trial, Evan can thoroughly review the case and present the strongest arguments to prevail on appeal. Among other successful results, Evan has obtained a full reversal of sex-crime convictions after a jury trial and a reversal of a first-degree murder conviction after an unlawful guilty plea.

Evan is a member of the National Association of Criminal Defense Lawyers and has volunteered with the Bar Association of San Francisco. Evan provided pro bono representation to consumers being sued for delinquent debts and served as a Co-Chair of the Criminal Law and Government Investigations Section of the Barrister's Club. He also volunteered with the American Constitution Society’s Constitution in the Classroom program, teaching Bay Area students about their constitutional rights.
